Immigration Didn't Take Sealed Envelope?

My stepson arrived today on a K-2 visa, but customs/passport control failed to take his sealed envelope. Is there something we should do with it? Will this be a problem when I send in his green card (AOS) application? Should I include this with AOS application, or will that only create a bigger bureaucratic problem and hold up his AOS processing? Any suggestions/opinions would be appreciated.

Yes, they supposed to disassemble the envelope and send it to USCIS! Did he get I94? What I94 says? I know situations when they allow people in but do not process it as K1, K2 or similar..

Go back to the POE right away and go hand it over it does not sound like they activated his K-2.

If getting back to the POE is any issue -

find the closest CBP secondary inspection / deferred inspection office,

and

GO IN PERSON with the child and the packet

then ask for the shift supervisor, give it to him/her personally.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You need to go back and give the packet, it could just be a normal I-94 as they may not have even activated his k-2. They may have just stapled in an I-94 and done nothing.

Okay, we will go back to the airport tomorrow. I'm not sure how to get in to see the customs people, but we will give it our best shot. What does it mean that the visa may not be activated?

You need to go back and give the packet, it could just be a normal I-94 as they may not have even activated his k-2. They may have just stapled in an I-94 and done nothing.

It means they may have admitted him on some basis other than the K2. In that event, he wouldn't be able to adjust status and get a green card.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Most airport CBP locations have separate deferred inspection offices either in a common area of the airport or in an office located very close to it (like right off airport property). You shouldn't have any problem seeing them but you may want to call them first. For instance, my local office doesn't always have people in the off-site location to help during business hours but will be available if you let them know a time you are coming.

Feb. 19, 2016 - NOA1

Mar. 14, 2016 - Biometrics

June 2, 2016 - Interview - Recommended for Approval

Much thanks to all who spent the time to post their wisdom. It was quite helpful, and the situation seems to be resolved. There is a website called CBP.GOV which has a contact phone number. By calling this number, I was able to get a phone number for the CBP at our airport and get the location. They said that all was in order except that they failed to take the envelope. I thought that was probably the case since the I-94 was stamped and the officer had written K2 inside the stamp.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
