K1 rejected NOW WHAT?

This is for Nigerian filers that have had K1 rejected and have married and are now filing for spouse visa. My fiance and I don't want to be apart for another year going through the visa process again. He was rejected due to fact that woman interviewer said only going to US for immigration purpose. This is not true. What are our options? We both cried last night and talked for a hour. This is so discouraging for us. The interviewer told him that if I go there and marry him in Nija there would be no problem with his coming to the US. Has this happened to anyone else? My thoughts are to go there and get married, establish legal residence and apply for DCF for the I-30. Has anyone else done this with success? Or do we marry then I come back to US and start the whole process over? :help:

You can do either way the DCF way or you can get married and come back to US and file for the CR1.

The only advantage to DCF is that you can live together until the DCF interview and then can fly back together; also it shows that there is serious commitment to your relation.

Its unfortunate your case got rejected, but many ppl have misused the K1 entered the country and continued to live here illegally.

Here is the chance to stand up and help against the illegal immigration so another couple does not have to go thru experience you have to go thru.

My thoughts are to go there and get married, establish legal residence and apply for DCF for the I-30.

DCF will not be an option after August 15th, there is no USCIS field office in Nigeria. You could live there, but you would still have to send the I-130 to the lockbox in Chicago.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

DCF is no more an option. But you can send your I-130 application to the Chicago lockbox for CR1 process, living in abroad.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

I am so sorry. My heart is heavy for you both. I hope you find the correct path to take. Have you tried contacting your congressman to request his file be reviewed by a senior consulate officer?

Marriage and spending significant time together in Nigeria would be the probable solution to the problem but DCF apparently will not be an option through Lagos at this time. You'll be looking at an 8 to 10 month process from filing to visa interview. The longer you stay together the better.

Facts are cheap...knowing how to use them is precious...

I did email my congressman, but didn't mention having a senior consulate look at it. I will do that tomorrow :) Thanks! My mom just called to say that she wants the info that I sent to my congressman so that she can email to hers to see if they too will help. Some may laugh but I even sent one to the white house. LOL.

Thank-you for adding the link. Very useful info. Now I know what we will have to do. Still not giving up on this application yet. It would be wonderful if they reconsidered and invited him back for a 2nd interview. Have to keep my hopes up.

My husband and I went through almost the same process,although I originally filed for the I-129 fiance visa,then during that process went back to Nigeria and got married so when I came back to the states I had to start all over from scratch.I wish I could say its a quick and painless process but it just isnt.I filed for the I-130 in June 2010 and his documents just got sent to Lagos last week,very discouraging.I also got a Congressman's office invloved and that was what got the train finally moving again.My calls were to no avail,just the same,its "processing" every time and I am a very aggressive person,I might add.Anyway,just keep the faith and get everything to them as soon as possible and you will be together soon.Not to worry,our fate is in God's hands,not our own.Stay Blessed!
