My daughter is hopefully getting her greencard in a couple months. My mother and sister are both citizens already.

Which one do you think would be a better choice to petition me and my husband?

My mother is 93 yrs old, what would happen if she petitions me and something happens to her?

If your mother petitions for you... Your process would take about 7 years (est.).

Your sister cannot file for you unless she is a US CITIZEN.

If your mother dies after the petition is approved then your sister could request the case be processed with I-864 you would submit.

According you USCIS

LPR or geen card holder CAN NOT petition for Married/Unmarried sister or brother (so this is not an option), only US citizen can

If your mother will petition you, the Priority date is JUNE 1, 2010 (which means they currently process applications filled by that time)

If your sister will petition you, the priority date is April 25, 2007

So your mom is your choice here and get ready to wait 12-16 Month till your petition is processed as cleared above

God forbid if something happened to your mom while the petition is being procssed so the petition dies and cancelled

If something happened to her after you are here, that shouldnt represent a problem to you

this is not true , looking to the montlhy processing times at USCIS.gov

CSC June 2010 priority date

VSC 5 month ,,,so depending on the Petitioner state you can determine the waiting times

Your sister cannot file for you unless she is a US CITIZEN.

( the sister is a US citizen as mentioned above and so she can petition her

Your daughter can only petition for you and her father after she becomes a US citizen. Green card holders (LPRs) cannot petition for parents. If she is married to a US citizen, she can apply to be a US citizen after 3 years as an LPR. If she is not married to a US citizen, it will be 5 years before she can apply to be a US citizen. It could take her 6-12 months to become a US citzen. Then it would take another 6-12 months for her to petition for you and her father.

Your US citizen mother can petition for you. Your husband would be a derivative beneficiary. The current wait is about 8 years. If your mother dies during the wait, the case is automatically revoked. If she dies before approval of the I-130, the case ends and there is nothing that can be done to reopen it. If she dies after approval of the I-130, it may be possible for your sister to request humanitarian reinstatement and be the substitute sponsor. However, there is no guarantee that humanitarian reinstatement will be granted.

Your US citizen sister can petition for you. Your husband would be a derivative beneficiary. The current wait is about 11 years.

A beneficiary can have more than one immigration petition. Your mother and your sister can both file for you. Why waste time with humanitarian reinstatement when it only cost $400 (approximate) to file an I-130? Once your daughter becomes a US citizen, you can calculate to see if it is faster to immigrate through her. If it is faster, then she can file for the both of you.
