here is what I have sent to NVC, awaiting response:

My application was expedited because of my fiancee's village, as well as most of Mindanao Island in the Philippines, flooding in June. Now it is July, and it will probably be September until I can get her to the embassy to interview. (the village will probably flood a couple of more times from Tropical storms or typhoons.) How is it humanitarian aid to take such time to process?

Why it is taking so long for K-1 visas to be entered from CSC. Is there a computer malfunction? An upgrade issue? Why is it mainly CSC? I am watching on Visa Journey. Many of us as seeing the NVC behind by a month for CSC. The USCIS assigns a date of expiration to K-1 visas. K-1 Visa petitioners have 16 weeks to interview at the Embassy. the Embassy can extend the date, but this is at the discretion of the Embassy. To wiat for USCIS to process, then have the NVC take 4 or more of the 16 weeks alooted the the visa process for K-1 is inconsiderate. I cannot even ask for an expedite until the case is entered. How can I ask for something to help her when the case is in a state of procesing between two sections. The case is no longer in USCIS control, but is also no yet under NVC processing control. No matter how bad the situation may be because the case is not uet in the system, I cannot make any requests.

saying there is 16 weeks to interview. NVC takes 4 weeks to process the K-1. this leaves 12 weeks. The Embassy can take another 2 weeks or more. This leaves 10 weeks. If you also take into account the medical cannot be done without the visa appointment letter plus the benficiary is female, plus she has to travel from another location to the embassy area. You are diminishing the 10 weeks left to now 6 or 7 weeks since a female beneficiary cannot do her medical on her cycle, plus has to wait one week by medical evaluation standards before the female beneficiary can do the medical. so depending on how things work and go in the scheduling, you take the ability to schedule from 16 weeks, down to 10 weeks, then 10 weeks, down to 6 or 7 weeks. HALF of the time post USCIS approval is utilized by processing.

K-1 viass have time limits. Very very short time limits. Other applications are based in dates, and priority. Please I ask you to resolve this problem.

I can understand your frustration because I feel the same. My daughter's petition was approved on June 22 and NVC has not received the case yet. They replied to my email saying:

Dear Sir/Madam:

Please be advised that the National Visa Center (NVC) contacted U.S. Citizenship and Immigration Service (USCIS) to locate your approved petition. USCIS has informed the NVC, that your petition is en route to the NVC. Once we have received your petition, the appropriate agent will receive further instructions within 6 to 8 weeks.

...6-8 weeks, that's ridiculous!! My petition in 2009 took only 10 days from USCIS to NVC. I don't know whose fault it is but I am thinking that it's USCIS' because they are the one forwarding the case to NVC so if NVC does not have the case, then they haven't forwarded it yet. :angry:

There have been quite a few threads on this...

Only CSC is affected....

Both I-129 and I-130s are affected

The problem is still getting worse.. Still double the amount of NOA2s being produced as being mailed to the NVC.. With a July 11 NOA2 you are looking at August 22-26 for it to just get to the NVC if they don't reverse the trend. I would expect them to stop falling farther behind in the next few weeks but not overly optimistic on them catching up anytime soon.. I was a bit enthused Monday (there were quite a few NVC receives that day and Tuesday morning) but then they are getting bulk mailed so who knows, they may not get another bulk mail for a week.

The approved petitions are sitting in a clearing house used by CSC USCIS to send out petitions. You can email them at csc-ncsc-followup@dhs.gov and have yet one more location tell you the problem does not exist.

On the bright side when USCIS and NVC do their next PowerPoint for their respective bosses those metric points are going to be very impressive.. Hopefully someone will squint their eyes at the data below the pretty graph that is showing all the improvement and say "If your approval time is now 3 months and the NVC is averaging 3 weeks to process the forms why is the time from NOA1 to Embassy receive still sitting at 5+ Months?"

Another thing to think about.. Even if they took all the NOA2s that are waiting today and did a big push to catch up.. The embassies could never handle the all the added interviews and would have to push back dates anyway (preferable to what they are doing now - at least with a date a person can make plans). The CSC went from five months to three months in a very short amount of time.. so there are thousands more petitions that need to be pushed through the system. There will have to be backlogs - I just never expected it to be in the mailroom of the CSC.

The K-1 Expiration argument will not hold much water with them - all those thousands of K-1s behind you that are waiting to be mailed have the same issue and are even older.

According to information given to me by an agent named Waldo at NVC this morning.

the NVC has the petitions. The petitions do not take long to get from CSC to NVC. However, the NVC has to input all of those petitions. The backlog is in the input of these petitions. As for hte embassies. If this was all one embassy I could understand. But these are multiple embassies around the world. NVC is the last flow in a "hose" before going out the nozzle end. the nozzle is a water diffuser, meaning going to multiple places around the globe. USCIS and NVC at two hoses with a connector. USCIS takes in the water, splits up the input to process, then connects all 4 "hoses" back to NVC. NVC takes all the input and processes. However, both sides are pointing fingers at each other. NEITHER side is measuring the metric between the two. this is a "loophole" gap. this is where the petitioner and beneficiary is suffering. the only way this will come to light is when USCIS/CSC has to start rectifying applications due to post-processing expiring application times.

You would think in this day and age with computers, It would be a simple bar code scan to transition from USCIS to NVC system.

I love that they tell us something different every call. I hope you recorded that conversation so thst at day 15 when you email the nvcreceive address and the "we don't have your petition we are sending the request to the USCIS" response comes you would have some ammunition.. Also if they have all the petitions why is it only California that is 30 days backed up?

Good point about the embassies and I don't know all the peculiarities.. but looking at Colombia: August is already booked up, September is booking up now.. Looking at the last few months they average about 50 interviews a day and seem to fill up every day of the month.. If the hose suddenly doubles it stands to reason the number to Colombia would double and they would just keep scheduling the 50 or so per day and just push out dates..

All I know is up until memorial day you can show an average 6 days from USCIS CSC to NVC. AVERAGE. There are some with 10 days or greater, but there are also many with 4 days. PLease note I am speaking in business days.

Since 5/30 (memorial day) things have started slipping. 6/4 times increased. ^/11 times increased to 30 days. and there is NOTHING since the weekend of 6/19 and 6/26 for CSC. Apart from one abnormality. But there is a lot for VSC at the same time. then it looks like 7/9 everything broke. Completely. The trend is showing either a contractor problem in what they are doing procedural wise or a computer upgrade problem. So far, it looks like a procedure. But whatever it is, it is HUGE. Just they aren't telling anyone.

I think the casefiles were held at CSC, not any slowness at NVC.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Accoding to information from USCIS, they ship out the applications the same day as approval. The USCIS centers do not hold onto the applications. They do ship via a courier or something. However, USCIS does not allow the operators to tell you a tracking number to verify shipment to NVC.

My case is closed? Yes

My approved case was shipped to NVC? Yes

Can I have the tracking number for the shipment? Hold, please. No we cannot give you that information.

How long to wait for an inquiry? You must wait 90 days before we can look into the matter.

Is there another way to verify receipt on the NVC side of shipment? Hold please, Just wait for entry into the system, notification will come to you.

Did my application go to the embassy? Hold, please, please follow the directions on your statement you received in the mail.

I am hoping to see my fiancee in 95 or 102 days from the last time I saw her. Approximately 42 or 49 days from now. But it all depends on NVC now, and the scheduling at the embassy. Aug 8 makes 20 business days.

hello

i have only two questions.

1. since when does the island of Mindinao get hit by typhoons or cyclonic storms????

(been going there for 5 years and everyone tells me there is no record of the island

ever being hit by these)ok torrential down pours and extremely foul weather, yes, Typhoons??? No

2. why is your timeline post dated?? i know you are anxious just like i was for my new wife to arrive but

putting the cart before the horse is a little dangerous in my opinion. remember you are dealing with a

large bureaucratic entity. anything can happen.
