So its been almost 2 years ( a few more days will make it official) and it hasn't been touched since December of 2010. I have a lawyer and have contacted my congressman, put in about 50 service requests or more total all to no avail. Other than suing USCIS i am out of options.

I left my home country and now life with my wife in her country.

I always call uscis to get the normal horrible service, dead end answers , no real help ever. They could replace them with robots and you would get the same service. Other than putting in a service request they can't do anything, Tier 2 isn't any better. For the life of me, I can't figure out why they would waste so much time on my case. Just look at it, take 10 minutes, decide , approve or deny . It seems simple to me rather than waste time and money on both of our parts.

I don't think much help can be offered for my post, but I just want to tell you all when you apply for your spouse be prepared if it back fires.

Are you committed enough to life in your spouses country and leave everything behind if the papers don't work? Moving from the usa to the Philippines was quite a big change but the Philippines has treated me very well. My visa process was done in less than 1 month here.

So this is the end of my rant, I wonder if I will be at the 5, 8 and 10 year mark on visajourney still waiting with no answers?

What responses have you received as for the wait? They must have told you something... Im very sorry that your at this stage and still no approval... im not familiar with the process when the wait is this long but at some point wont the i 130 expire? If it does can't you refile?

I tried to follow up with your timeline

I-130 doesnt expire, but it seems to me that something happened that you dont know, like they lost your petition etc

You might do the next steps if you didn't:

1:contact VSC directly via E-mail at vsc.ncscfollowup@dhs.gov and explain the situation and dont forget to provide all the informations about your petition, like the receipt No, date it was filed and received, names etc

2: Email the Ombudsman Liaison Unit at OLUInquiries@dhs.gov as they seek customer feekback as well as getting involved in cases similar to yours, please dont forget to make sure your email is detailed as possible with all informations related to your petition

3: If that didnt work, go a head and withdraw the petition, and when you get a confdirmation it was withdrawn and you lived 6 months in Philipines, go to the embassy and file another I-130 through (Direct consular filling DCF)

if none of the above worked, its up to you to decide what your next step will be
