This is going to sound like a really strange question and situation, but here it goes.

My daughter in law came here to U.S. on a K1 VISA, married and applied for AOS. Everything is going very well for them; however this question is in regards to her sister and her AOS situation.

She (Filipino) is married to an American and has been for about 4 years now. She just recently after going through many hoops and hurdles got her VISA approved. The situation currently has her living with her mother-in-law, (Husband is currently not living with family) When VISA was approved they were aware of situation and approved VISA with letter of family support and now MIL is not really giving much help for her. Now I'm not sure if only MIL was listed as family support system or if her sister and family were also listed. Unfortunately we do not live near where she is located.

She needs to file for AOS is this correct? How long does she have to file because he will be with family after the beginning of 2012. Would it better for her to have the papers ready to go and send in closer to the time he will return to family or will it not make any difference if she does this without him, am especially wondering about the interview she will have to do?
