Hi VJ members,

Me and my USC wife filed "Married filed jointly" on our 2010 tax year. So, in my USC wife's i864 line 25, what amount should I put on 2010 tax year? Should I separate my wife's income from mine and enter that amount and attach a copy of W2 for proof?

Correct. The sponsor's individual past income is what goes there.

If you want to use your current income to qualify for the household requirement that would be listed on line 24 b. You would also check the box for 24 e and put your name on the line.

Correct. The sponsor's individual past income is what goes there.

If you want to use your current income to qualify for the household requirement that would be listed on line 24 b. You would also check the box for 24 e and put your name on the line.

Thank you once again for your prompt reply. As you might know, I am using my father in law's income so I am putting his name on line 24 b and I am checking the box 24 d. Am I on track?

Do your in-laws have any other dependents in their family? If so, it may be clearer to go a different route. Reason being that you all live under the same roof.

If your FIL is the head of his household then it may paint a more complete picture to the adjudicating officer if he does an I-864. That shows his total household plus you.

Do your in-laws have any other dependents in their family? If so, it may be clearer to go a different route. Reason being that you all live under the same roof.

There is no other dependents in the family. There are 4 of us living. Me, my wife and my in laws. My FIL is the head of household, I am assuming that head of household meaning he is contributing to most of the expenses.

Also, on line 8 should my USC wife check on "Yes" or "No"? Please let me know if you have any doubts on my form. I really appreciate your help.

You are the lone immigrant in this scenario. So that is a "Yes."

If it's just MIL and FIL in the house with you two then Dad doing the 864A ought to be cool. Just wanting to see you present the clearest picture so that the IO feels comfortable.
