I file IR1 for my wife she's out of us.

Today I get this letter from NVC:

“The Immigration and Nationality Act (INA) does not allow derivative status to family members of immediate relatives. IR1, CR1, CR2, IR2, and IR5 classifications are immediate relative visa categories.

This means that a spouse, unmarried child under the age of 21 and a parent of a U.S.

citizen require their own individual petition in order to immigrate to the U.S.”

Does someone of you get this letter??? Please help me

Is this an error??

Thank you very much!!!!

Need more information,

1. What is your legal status in the US?

2. Was the petition only for your wife? There are no children involve?

3. When did you file the petition and what was your legal status when you filed?

More information is always good, less has no value.

Please fill out your time line for future reference.

You file for a CR1 petition, by filing a 130 petition application.

You received your NOA1 on mmddyy?

You received your NOA2 approval on mmddyy?

Petition was sent to NVC on mmddyy?

Have you started the NVC process yet?

Letter seems to be in error, but without all of the above facts can't make a definite answer.

Crystal ball not working.

It sounds like they think you are petitioning for more than one person- ie your wife and a parent or child or someone. But like the others said, without knowing your timeline and whether you received any RFEs (requests for additional evidence) it is difficult to say. You could also try calling them and asking.
