I would wait until the interview. If it doesn't come up, then no worries. The caution though is that there must be a divorce decree. His mother need not "find" it. He can simply request a certified copy from the proper channels if he doesn't have one already. Hopefully your husband is reading these responses, as he'll understand better what needs to be done to obtain the document.

so you mean I just need get his statement of that mistake and his certified copy ready for my interview?

I do worry this mistake will get my visa denied,as they think my husband lied or they think will need more time to check to give me the visa.

That's all possible but I'm focused on what to do to be prepared for questions and how to deal with the questions. You can't change what is already done and nobody can predict the future.

About prior marriage,they ask for dirvorce paper,that's because they want make sure this marriage is valid,right?or have other more reasons?

Evidence that prior marriages were terminated is required. That's why the question was asked on the forms in the first place.

We are going through Electronic Processing Program‏ now.

I have one question ,when they do background check of american part, they must find out he married before, why they did not ask us to provide the papers? and they arrpoved the papers.

I think it was missed during USCIS adjudiction, to approve the I-130.

IMO, it's too late to add it in during EP, at NVC - but even with that said....

The biggest hurdle he's going to have to overcome, IMO, is misrepresentation. If you got married in China, then he had to have some form of 'free to marry' affadavit prior to hitting the China Marriage Office in your city, usually that affadavit will list any prior spouse's name..

So - where are some entry points, to correct this oversight?

1. at NVC - he can request that his divorce documents be added to the casefile, on DS-230 intake or

2. at document intake day for the interview in Guangzhou (the certified set is supposed to be handed over that day, anyway)

I would suggest to him to call NVC, ask for a Supervisor, let him/her know that he messed up the I-130, and ask what they suggest to do.

Good Luck ! Being slammed with mis-representation is no fun, especially on interview day at Guangzhou IV !

We got married in Mumbai India two years ago, I don't think my country has any informations.

where are some entry points, to correct this oversight?

1. at NVC - he can request that his divorce documents be added to the casefile, on DS-230 intake or

2. at document intake day for the interview in Guangzhou (the certified set is supposed to be handed over that day, anyway

Now I think just this two options,but which one will be better?

I'm thinking email his divorce papers with my DS-230 .

I do worry they not collect these papers at document submit day,if so, all will come up to me when my interview ,that will be very bad.

But email to NVC with my DS230,what if they cancle our approved I-130 and tell us will need to review our case?

Can they cancle the approved I-130?

Just remembered when we sent the application of our marriage, the local marriage officer asked two envelopes with stamps,they said one would mail to america embassy ,one to china embassy .And public our application for 30 days,there was no objectation, then we got married .

Hope after we send NVC the statement of mistake won't make any other problems,I will keep update.

today I found someone when she sent the DS230 and I864 to NVC,because they did not mail one letter of explaning prior,so they email one explain letter too (also Electronic Processing Program‏ ) ,after one month, still no news, so they made the call to NVC and be told the case back to USCIS.

This makes me feel so bad of my situation. :crying:

did that report include the details of a phone conversation with a visa specialist at NVC, or no ?

IMO, to simply 'submit something' without that conversation, is massively scary.
