Prior/Former marriage and Affidavit of Support

Hi all,

I just found my husband (american) filled N/A on the Prior wife (G325A and I130) when he sent the application,but he did married before(though long long time ago),am I in big trouble?

We already paid 88usd and 404usd, my case will change CR1 to IR1, now just wait to send 230 form ,I-864 and other support papers.

Another question,my husband works overseas ,america company,his income is good enough to support me, but it's overseas ,should I worry about this? If we need to ask my mom-in-law be our joint sponsor ?

If his background check comes back showing a prior marriage then there may be questions. Why take a chance to have delays and complications.

Not good, by putting N/A on the form, your husband was stating that he had not been married before when he has been. Not good at all.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Not good, by putting N/A on the form, your husband was stating that he had not been married before when he has been. Not good at all.

Here is another potential problem. At your interview you swear to tell the truth. Will you answer a question about this honestly or not? If your honest answer is different from what your husband indicated the difference has to corrected.

If you do not give an honest answer and this is discovered it could be a huge problem. One where a visa cannot be issued.

Your husband ought to answer truthfully. We play by the USCIS rules when seeking a visa. His reasons for not answering honestly really don't matter.

There is nothing you can do until you are contacted. He will have to provide proof that he is free to marry by providing evidence of his divorce. This will delay your case.

Why did he list "N/A" when he obviously was married? Tell him to be truthful. If he answer less than honestly because he is lazy then he is putting you at risk for a denial.

I will tell the truth for sure.

I'm thinking let my husband write a letter to state about this problem by email to the NVC and provide his dirvorce paper,do you think this can help?

We are going through Electronic Processing Program‏ now.

I have one question ,when they do background check of american part, they must find out he married before, why they did not ask us to provide the papers? and they arrpoved the papers.

Thanks for ur reply,we did not send the 230 and I864 out yet.

I checked I864 form,there is no place to ask about the former marriage,how can we make the statement of that mistake?

I'm sorry. I thought you were referring to a previous spouse who immigrated to the USA. I see now that you mean he improperly completed the G325a and I-130 with regard to the prior marriage. At this point, that cannot be directly corrected. If I were in his shoes, I would obtain a certified copy of the divorce decree or death certificate as applicable, get it to the foreign spouse and then have you be prepared to answer any question about this if it gets asked. By any question, I mean you should be prepared with HIS explanation about why he indicated N/A with regard to any former spouse. What was his reason? Does he have a certified copy of the divorce decree?

I do not know how they check his background, they should find out this problem and ask us to provide more papers ,instead, they approved our I 130.

I really don't want them think I just get know he married before when interview time, I knew my man more than 4 years ago and we married for two years now, he did not lie me about this issue, but I do worry they think he does.

I would wait until the interview. If it doesn't come up, then no worries. The caution though is that there must be a divorce decree. His mother need not "find" it. He can simply request a certified copy from the proper channels if he doesn't have one already. Hopefully your husband is reading these responses, as he'll understand better what needs to be done to obtain the document.
