Change from O1 to green card whilst not in USA

Hi there,

I just won the DV 2012

I currently have an O1 visa but have not utilised it. And am still residing in Sydney.

I read that it's easier to apply for the green card through the consulate rather than doing an AOS in USA. It will take less time that way.

My question is, do I just apply as if i'm not using the O1 currently, or do i have to do an AOS through the consulate?

The O1 is valid until August 2013. However I'm wanting to apply and get all this done ASAP.

Should I still just send off the DSP-122 and DS-230 forms straight away?

Congratulations!

You send what's required in the steps 1 and 2. You will not be called to an interview UNTIL your number is current so check out the visa bulletin at travel.state.gov

You can't do AOS through consulate - you will do regular consular processing of DV visa. Since you're not using O1 now, you're not in the US, you're doing consular processing.
