Hallo everybody!

I am a sister of an american Citizen!He was filling for me I-130 at 15 April 2002,in California!In 18 October 2005, my case was approved ,and sent to NVC!My question is:this year a company will fill for me a petition regardind to H1B visa!Can my I-130 approved to be an impediment for H1B visa?Should i tell them(embassy)about this petition(sibling)? :)

H1 allows dual intent so you would have no issue.

It would be 8 years or so more before you obtained a Visa number, so this seems a much beter bet.

If you can not get sponsored for a GC on the back of employment, the H1 and its extensions would be running out give or take when you visa number would be available.

The company wants to sponsor me for GC!Perhaps,do you have a clue :how many years will take for me to receive GC in this case?

I was analyzing the priority date for F4(sibling)and i think that until I obtained a Visa number it would be 5 years, and not 8 years.It's moving a little faster in the last 2 year!!! :):yes:

*07.29.05 sent package i-129f to california

*08.02.05 recveived NOA1

*10.17.05 received NOA2

*11.01.05 colombia's embassy received package

*12.05.05 interview date

*12.06.05 recieved VISA

*12.20.05 came to U.S.A!!!!

*12.28.05 applied for a Social Security

*01.05.06 received Social Security card =)

*02.11.06 married....

**AOS**

*03.01.06 sent package for AOS & EAD

*03.03.06 package arrived at unit (Chicago,il 60699)

*03.18.06 NOA1 for AOS & EAD (notice date 03.08.06)

*04.15.06 he had his Biometric taken

*04.17.06 EAD & AOS touched

*05.03.06 AOS touched again & case transfered to CALIFORNIA.

*05.12.06 EAD APPROVED!!!!!!!!!!!!!!

*05.16.06 AOS touched again!!!!!

*05.17.06 EAD approval notice mail it, from USCIS office...and AOS touched again....

*06.12.06 AOS APPROVED

*06.19.06 we received my husband's GREEN CARD!!!!!!!!!

you cant have 2 visas.. so cancel one you cant have an H visa with a k visa .. congrats on your petition being approved

Actually you can, but there would be little point as the H allows dual intent. Plus of course K is not relevent.

As far as the H GC process, there is a backlog, very much depends on which category you are in. I would keep both running and see which one comes through first.
