Question about petitioning for mother

Timeline

My Cousin used to live in Texas from 1991 until 2002.She left and returned to her home country.

Now her US Citizen daughter (living in Texas) want to bring her back to the USA.

My Cousin abandoned her Green Card when she left plus in 1998 she had a charge for a bounced ( 100$ ) vheck and spend 3 days in jail.

What exactly would her daughter have to do to get my Cousin overhere? And would my Cousin have to do AOS ??

Also is the bounced check charge a big deal ?

My Cousin has NO papers as to the Incident with the check.

Any advice is greatly appreciated !

Your cousin's daughter can file an I-130 petition for an IR5 visa for her mother. It's an immigrant visa, so she wouldn't have to adjust status. She'll get a green card shortly after arriving in the US.

Bouncing a check is not a crime of moral turpitude, and does not fall under any other section of INA 212. She won't be inadmissible for it. She WILL have to answer "yes" to question 41 on the DS-230. The consulate may want to see court documents regarding her arrest and conviction in order to determine if it's an inadmissible crime.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
