I AM SOOO UPSET RIGHT NOW!!!

Okay so after 6 weeks after our interview and no paper given to my fiance from the Embassy. They told my fiance they wanted the I134 and more photos. SENT IT TWICE!!! :angry: I've emailed them a few times and have called them every week. And everytime I get the same response we have all your documents and we haven't reviewed them yet or your case is still pending per ODS. Then after talking with someone again last week at the embassy they said they would try to look at our case this week. BAD news they did they emailed me today said they need more relationship proof. I had sent them over 20 pictures. I had sent in with my petition all the phone bills and air line receipts, hotel receipts from the time we met till the time we filed. I sent my fiance letters from my sister and mother, I sent more phone bills since the time we filed and till the time we got the NOA2. We don't email because he doesn't always have access to the internet and his english writing skills are not so great. We don't skype or do instant messenger. We talk to eachother 5 times a day minimum. Because I am on a family plan with my parents and sister I do a prepaid cell phone and calling card combo to keep costs down. Because after the first month he left I went way over our minutes and the long distance bill just about gave me and him a heartattack not to mension my parents. I've sent him copies of my bank statement to show the prepaid cell phone and the calling cards that are just Switzerland specific. I have a few calls on my family plan showing that I called him. I don't know what to do? :(

In addition, have you provided primary evidence (such as actual airline stubs)? I see you had RFE during your I129F. What for?

We met online early sept 2009. He then came to visit some friends in California. and so we decided we would like to meet in person. We met in person Oct 2009 and for the next three months while he was in the united states we would fly between minnesota and Cali. Seeing eachother every 2-3 weeks. So we met 5 or 6 times. We had thought about me moving to his country but due to the economy his business went under. So now with no income and no longer able to afford a place of his own he had to move in with friends. So late in august of 2010 we decided we would move forward with the fiance visa and he would move here since I had a decent job and my own place and that all my family lives here. We filed at the end of setp 2010 for the fiance visa. Waited 5 months like many people here then got and got an RFE sent that back in and was approved for the petition at the end of March 2011. We moved quickly to get all the info required for the interview. Now here we sit 6 weeks later with a slap in the face.

RFE for for primary evidence and a certified copy of his divorce decree. He came here so I didn't have a plan stub nor the visa stamp. I've never been married before so there for never divorced and had no idea what divorce decree looks like. I had asked my fiace for his divorce papers I guess what he had sent me was just his civil status he was divorced. (lost in translation literally!!) :wacko:

I had sent in copy of the receipts of the hotels we had stayed in and copy's of the receitps of our arline tickets. (didn't have the boarding pass didn't know I was going to ever need them) He sent me copies of his entry stamp to the US and a Copy of his divorce decree and sent that in and was done and over with in 2-36 weeks and then following that recieved our noa2.

HOw long have you known each other? How many times have you met in person? If you provide the timeline in a bulletpoint format we can help

we've know eachother just shy of 2 years come september.

Basically, you met only once (the fact that you saw each other every 2-3 weeks during his single visit here is not considered multiple visits. This is reality. As far as they are concerned there was only one visit documented (with primary evidence). This happened 1.5 years ago and this is unusual for K1. Most of applicant see each other more often. While there is requirement for I129F approval "last 2 years", in reality in the embassy they want to see much tighter relationship.. I am pretty sure this is where the problem is. You need to search for more evidence of ongoing relationship. This is right, this is not sufficient even for no-fraud countries. You need to think what you can provide in terms of evidence. You would know better. My recommendation would be to search for it and provide it. I think this is a problem and you will not be able to overcome it unless you provide a very substantial evidence that you were interacting every day. And I mean proof. They cannot confirm if the phone card that you were using was in fact used to call him. You either have to find something like that or need to visit him again. This is my take.

I called my calling card company. I called them before asking them please to give me copies of my calling records they said no. So I called again just today after getting this horrible news and pleaded with them about what I need them for. I spoke to some one with a kind heart and told me that I could send them a notorized letter stating what I need and that I could get the 6 past months and that they would email it to me. YIPPEEEE!!!!!!!! But I have been planning to go see him at the end of this month if we didn't get the visa. Well we are going take a ton of photos and send it to them with our hotel receitps and boarding pass!!!! :hehe: (to the embassy) ;)

Until now I have been a bit cash poor but now have enought to get a hotel and flight and a little extra for food and fun. We've been trying to save money till now hoping we didn't have to make this expensive trip. (BUT TOTALLY WORTH EVERY PENNY!!!!):yes: :yes: :yes: Didn't thnk it was going to take this long?... :huh: But now I get to see his home country. :)

Sunny123, did they keep the passport or give it back? Also do you know how long you have to return the requested documents that they want?

11-07-2011 delivered

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

Spending a lengthy time in the same country and seeing each other periodically is

totally different than flying over to meet someone once to check the box for the

2 year requirement.

Not sure thats the issue here as much as lack of documentation.
