Hello everybody, its been long time since i last was here, let me tell you that my life has gotten much better since my last situation.I divorced after almost 4 and 1/2 years of marriage(so yes, I'M A LEGAL PERMANENT RESIDENT(10 YEAR CARD)sadly my ex husband and I had our diferences, but more thna that there really was family violence from him towards me and an incident that ended up being "like a family violence" (switched to something else later )arrest and charges for me due to his fault (my ex tried to talk to the distric attorney explaining it was a mistake calling the police,it was only for help to take me somewhere else, but this State prosecutes you no matter what)but everything ended up resolved by a lawyer, charges lowered (not erased cause state was not going to drop anything)and proven my inocence!!!,no record of guilty neither conviction:):):)....(weird anyways cause a damn apartment recently saw me as a delincuent...and denied me the rent of an apartment:()...well...Later after our divorce i was able to travell to stay wiht my parents out of the country and come back to U.S.A and at the port of entry there was not any troubles more than a few questions regarding the arrest and end of story. Now, i got my divorce in april 2010, december 2010 met a wonderful man, our relationship is awezome,we would like to get married and later travel as a married couple to my country as a honey moon and to visit my parents:).

my questions regarding this are: Did i have to notify USCIS of my divorce?I have only notyfied them of my new address.I dont know if my ex husband has done the same.

Do I have to notify the U.S.C.I.S if i get married again?what should I do to do this?

Do I have to change my last name on my green card, meaning apply for a new green card so I get one with my new married last name? What makes me worried is what if NOW they see my "background" again (they saw it already at the port of entry)as a problem to get a new green card and decide to deport me,considering the very good outcome at the port of entry,I dont think they would but You know...you never know...

After getting married should i wait for my new green card(if they give it to me) before travelling?or could i just travel out of the country then come back only using my old green card, marriage license and copies of the papers showing i have already applied for the new one but still waiting?

PLEASE IF ANYONE HAS BEEN EVEN IN ONE OF THESE SITUATIONS LET ME KNOW WHAT TO DO,OTHERWISE I MIGHT HAVE TO HIRE A LAWYER AND MY POCKET IS KIND OF TIGHT RIGHT NOW,THANK YOU EVERYBODY:)

There is no requirement to notify USCIS of your divorce. They're really not interested because they care if you had a bonafide relationship when you entered. If it took 4 1/2 years I don't think that's a problem. Heck, my first marriage only lasted 6 years and I didn't tell them. You are required to file your AR-11s when you move, but that's it.

The only impact it had on me was that I was 2 years into having my GC (it was a 10 years card because I went the I-140 route) so I then had to wait the full 5 years to apply for citizenship rather than 3. The only notification I gave them was on the naturalization forms where I stated my marital status and when the divorce was. There were no questions on this at interview.

I did get married again, and I did notify USCIS, but only because I was dumb enough to fall in love with a Canadian. :bonk: The notification took the form of a pair of I-130s for wifey and new stepdaughter.

I do not see any problem with your divorce and travel.

Are you marrying a US citizen/LPR or not? He may have a trouble with traveling if he is not.

Your arrest and court case is another matter. You are not very clear on charges and the outcome of your case.

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

Yes,he is US citizen. The charges are not family violence anymore, something different exactly worked out with the lawyer to try to void complications with uscis, but could not been erased, dropped or taken away, avobe i said:not finding of guilty was entered on my record,so there was not conviction, letter from court, but this was after they made me go throught a damn court process. The arrest was not erased neither charges from my background so it will always show up for anyone who looks for it on my background, this State prosecutes you no matter if who truly or falsly accuses you wants to drop the charges, ex husband tried explaning his real intention getting in touch with 911 but they didnt care at the court house. That's it.

I'm going to get a letter from my ex explaining what happened,so at least i have a backup for my innocense regarding the facts of what happened that damn day:(,the letter from the court is more important anyways but i already have it.

I haven't changed my last name, ever, so I can't advise there. (I'm an Alexander not Alexandra). I naturalized in 2007 or 8 (memory's foggy) and got married at the end of 2010 and am still trying to get through the NVC moras, which is why I'm hanging around here.

No, you don't have to notify USCIS if you get married again.

No, you don't have to change your last name but you can if you like to..

No, you don't have to apply for a new Green Card if you changed your name but you can if you don't mind spending $450 on it. Otherwise you should formally change your name when you apply for naturalization, in case you plan on doing that.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.
