Oh I see, so I did understand you correctly about the K1 visa filing again, that is a new option. I am planning another trip within the next few months...which is better route K1 or CR1 which is faster. Either way, I am going to file again.

As you know from your own personal roller coaster ride there is no "better route" I agree with Nigeriaorbust that it may be in your best intrest to refile instead of waiting on USCIS to send you a letter of expiration. I think you should pray about it and decide what will work best for you guys whether it be K1 or CR1... Just make sure you do a good job of dispelling whatever it is you were lacking the first time around if anything but as you know Lagos is like that!!!! I am praying for you sisterfriend GOD bless you on your decision :thumbs:

For those of you who don't know our situation let me share this with you all. First of all I want to say to all the petitioners and beneficiaries. This road is a long one and one never knows what they will encounter along the way.

The next morning, the embassy called my fiance yet again and told him over the phone his visa is denied and the petition will be returned to the US to my local USCIS office.

Our petition bounced every which way since November. If the intention was to deny from the start they should of done so. But they decided to use every card they can on us.

My being born in Iraq became an issue, our age difference became an issue, my being divorced became an issue, him never being married became an issue. ALL THE RED FLAGS WERE HANGING FROM THE TOP OF THE US EMBASSY IN LAGOS WITH OUR NAME ON IT!!!!

No one is above the decision of the CO. We are in a great deal of pain as it is, so both of us would appreciate constructive opinions and thoughts. Your thoughts are welcomed and prayers even more.

They do not look at the documents you bring to the interview if it wasn't in the original packet and they didn't ask for it then its pretty common practice for them to have their mind made up at the time they sit down to interview. If they have doubts they have a list of questions.

Hopefully you know what you are getting into, but there is no way to know what the Co knows.

However, if you had accompanied your fiance to one of the interviews, would it have made any difference to the interviewing officer, to establish the level of your commitment to each other? Just my personal thought :wacko:

Yes you have a point there. Accompanying him would of been a good thing to do with Lagos. We have learned an expensive lesson. We are moving forward from here on more prepared and ready for the next stage.

Most of our petitioning and document sending was done prior to joining VJ, so we did it without realizing what was up ahead. WE both joined VJ after the first interview was already done with and we were on AP for four or so months.

All in all what is done is done, we pick up the pieces and get prepared for the next step. Committed and more prepared, yet we are open to suggestions of the wise VJ members, who themselves have traveled down this treacherous road.

According to our records, this case was returned to the National

Visa Center. It will take several weeks for DHS/USCIS to receive

and determine action on your petition. In most cases DHS/USCIS

will not contact the petitioner upon receipt of the petition

because of the short validity period of K-1 petitions. She is

allowed to file a new petition, or marry you and file for you to

immigrate as her spouse.

We would advise that you contact DHS/USCIS with any additional

inquiries as the case is considered closed in Lagos.

This is their email to us regarding our case.....any suggestions???
