K3 Spouse Visa Filing

Hi folks,

I married recently in India and my wife is a US citizen. I am on H1 in the US and looking to file for my K3 Spouse Visa and i had a few questions and i would appreciate it if you guys could help me out.

1.Would i need the services of the attorney or could i do it myself?

2.What forms should i and my wife fill for the process

3.What are the checklist of documents i got to send to USCIS..Should i send the original of my documents or copies of them suffice..for ex my birth certificate

As you are currently in the US you won't be filing for a visa but to adjust status. I believe you'll be sending in the AOS [i-485] and I-130 paperwork at the same time.

As long as there is nothing questionable in your past [overstays of visas, criminal record, etc] many people are able to fill out the paperwork and do the process on their own. Please read through the guides here. They are very detailed and straight forward.

as an H1-B visa holder, you are allowed to adjust status without filing a K-3 visa.

We've a guide for that - please review the guides section (scroll yer eyeballs up, click on 'Guides' )

IMO, filing for an Adjustment of Status whilst yer in country and allowed to adjust without filing for another visa is a boon, not a boondoggle. Also IMO, a K-3 would be a boondoggle.

Also what is the mode of payment? Cheque or Credit Card and whom should it be addressed..

Married is married. No need to marry again or "register" the marriage in the USA. If are unwilling to carefully study and follow both the guide and the form instructions, you should probably hire somebody to manage the process for you.

Facts are cheap...knowing how to use them is precious...
