Husband in US Army need help with something wuth JAG

Timeline

Ok my husband has been in the US Army for a year now. On June 1, 2011 he became a US citizen.

Today he was asked to go to JAG. when he arrived there he was told per a security clearence he HAS to bring his

Romanian passport to them so they can shred it and he HAS to renounce his Romanian

Citizenship or be kicked out of the Army. This just does not sound right to me, especially since

Immigration informed him he can keep duel citizenship.

Hes seriously upset over this as am I.

Plus he already had a security clearence before going to Basic Training. It was the intence clearence.

Anyone have any advice? Its so upsetting :(

Check out Foreign Passport and Security Clearance ... and DOD's "Money Memorandum"

Your husband could always ask JAG to show them the clause in the military regulations under which they are requesting his passport for shredding, and to provide proof in writing that he has surrendered it and that it has been shredded. Technically, hubby should then notify his Embassy or passport issuing authority that it has been forfeited, to whom and the date, as a passport is a legal document.

Timeline

Tell your husband to read Army Regulation 601-210. Members of the US Army cannot hold a security clearance if they have dual citizenship. If he doesn't renounce his foreign citizenship then he'll lose his security clearance AND his job.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
