F1(Without OPT) to H1

Timeline

I did my masters from NYU-Poly. I did not apply for OPT and joined PhD course in ASU. it happened one year back. Now I want to quit the course. My employer has filed my H1 on june 30th. The thing is even if I get H1 i will still be on F1 until Sep 30th. Do I need to take 9 credits course in Fall to maintain my status in usa? My attorney told me I come under cap-gap, so I dont need to take any course.But when i contacted college they told cap-gap is not applicable on me. Would any one suggest me in this matter?

I think your school is right. you have to be enrolled in school and maintain your status until your H1 is approved. Applying for H1 does not mean it is approved everytime.

I would not just go by attorneys word, its been proven here multiple time they dont know what they are talking.
