Hello,

My wife and I are currently in the process of preparing the I-485 package. However, I have a question... at Part 6, Question 25, it asks for her total income as per her three most recent tax returns, however, according to the form she is only required to provide her most recent return (she is my sponsor). Now we have her most recent (2010) to hand but not for the previous two tax years. We do, however, have her W2s for the previous two years (she filed a return, we've just dont have them to hand). Therefore, would it be acceptable to simply provide her most recent return, together with the sum totalof her W2's for the previous tax years as well as a letter from her employer and recent pay stubs?

She needs to have filed her taxes for the last 3 years.

There's a spot to write the income FROM the tax returns for those previous 3 years. While you only need to include the most recent tax paperwork, you DO need to fill in all three previous tax years information.

I wouldn't rely on the W2's, order tax transcripts from the IRS.

We didn't want to cut corners, but because of the hastle and the time it would take to obtain transcripts from her previous tax years, it would of course be easier to use the figures from the W2's, especially it only asks for the most recent tax return. Has anyone ever received an RFE for the previous two years when they didn't enclose these?

It is not about including them. You do not have to include all 3 years, only the most recent year is required. However, you need to fill out #25, and put the amount of her total income as reported on her Federal tax returns for the last 3 years. You can get tax transcripts from the IRS for free by going to your local IRS office and getting them right then and there (wait time about 15-30 minutes), order them online, or order them by phone. They will mail (about 1-2 weeks to receive), or fax them to you right away.

You might as well have three years of returns on hand. We had to bring the last three most recent returns when we did our AOS intereview, however, since I included three years worth of returns with the application, the IO only asked for the most recent return.

You can your transcripts faxed to you in a few hours by making one phone call. Not a lot of hassle. See the phone number in red in my signature below.
