non impediment and previous marriage(divorced)

this process is beating me senseless :wacko: .....i have one question regarding the non impediment certificate and a previous marriage. My fiance was previously married and was divorced in 2006 . The marriage took place in jamaica ,but the divorced was done in california. We sent in a certified copy of the final divorce decree with the orignal petiton and I have five copies of the decree available to me on hand. He went to apply for the non ipediment certificate and on the non impediment it showed that there is a marriage found.

1)My question is when my fiance applies for the non impediment ,should he bring the decree with the the RGD so they can see that he is divorced ?

2)Do they informaation on the non impediment change when the person is divorce?if it does please tell me how can what are the exact things we need to do to get it changed?

3)Or does the certified copy of the final certified copy on the divorce enough proof to show that he is indeed single and free to marry?

I called the RGD , Ministry of justice of jamaica and they all gave me diffrent answers...i made a friend call in jamaica and the RGD told her that they dont need the divorce decree and all they issue to personal is either or not a marriage is found .The RGD told her that all i need is the non impediment letter(saying a marriage is found) and the divorce decree together and i should be fine...

sorry for the long post but my interview is 27 days away and I feel like im on overdrive...so my fellow vjers and Yardies roll out and please help me cause i know i will find the most help here.another thing if i post this in the wrong place...someone please to right place...thank you :)

Hey Night Nurse.. i received your email and will give my best answer. ... So a marriage was found because the RDG was not updated with the divorce done in California, USA. Since the applicant is divorce it is necessary to bring a copy to the office (or RDG) and and see if they will be able to re-issue the document showing free to marry. If they are not able/wiling to update the records/reissue the document then he should take the divorce decree to the interview on July 27... I'm sure that it will go well.

I'm wondering what forms they accepted? We are in the same situation! My fiancé married in Jamaica then divorced in Canada. He got a letter from the registrar general showing his previous marriage. Does he take that with his divorce decree to the interview or does he try to get the registrar general to issue a non-impediment with his divorce decree? Thanks for your help!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
