My mom, LPR, petition my unmarried brother, who is in the Philippines last Apr 2010. Petition was approved but we are still waiting for visa number. My brother recently turned 21 years old last June 23, 2011. Will he be eligible for the CSPA? Please help me compute his adjusted age. Here are more details:

Brother's Birth date: June 23, 1990

Approval date of petition: September 15, 2010 (Approval notice)

Priority date: April 18, 2010

Priority date: April 18, 2010

USCIS took approximately six months to approve the I-130 (4/18/2010 to 9/15/2010). This means that your brother has an extra 6 months after turning 21. If his PD becomes current in the F2a category by the Decemember 2011 Visa Bulletin when he will be under age 21 years and 6 months, he gets to process in the F2a category. If his PD becomes current in the F2a category after the December 2011 Visa Bulletin, he will age out into the F2b category and CSPA cannot help him.

Can't believe I missed this. Ignore my earlier post.

Retrogression in the PD affected your brother. His PD became current in the December 2010 Visa Bulletin. This means he was under 21 when his PD became current. Once his PD becomes current again in the F2a category, I believe he will be processed in that category.
