My husband was denied; we are starting over :(

To our complete surprise, my husband's spouse visa was denied a couple months ago. Two stupid factors came into play. The translation of our marriage certificate had a mistake in it we did not catch (but USCIS did!). Secondly, his divorce from his previous marriage needed more proof that a 'public court' in saudi *IS* in fact governed by Sharia Law. Isn't that a crock? What court in Saudi Arabia would NOT possibly be under Sharia Law!!??!!??

Well suffice it to say, we were sick and beyond traumatized. Thank God USCIS did not deny with prejudice and we may refile. We have gotten the marriage translation fixed and gobs of proof about the Public Court system there which should satisfy their stupidity.

My only concern now is if we should re-file using an attorney this time around and play it completely safe.... I do not want to pay a lawyer $3k-$5k but am scared to death to do anything wrong this time around.

I would appreciate advice from anyone :( I have not seen my husband now since April 2010. Hopefully we will have a visit in October at least while this nightmare continues.

Having (and paying) an attorney does not mean everything will be smooth, there is no guarantee an attorney would have noticed the translation error or would have had the foresight to include supplemental evidence about the Saudi public court system.

From what I can tell in your post, you did everything else correctly and have taken care of the things that caused problems. Ultimately, the decision to hire an attorney will be yours.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Sounds like it was the petition, not the visa that was denied. Please clarify. USCIS doesn't deny visas. They approve or deny petitions in spouse cases.

Sounds like since you are saying spouse you filed an I130 already and they didn't like the marriage certificate at the Embassy. Not sure if you just go through NVC again or recontact the Embassy to schedule another VISA appointment with the correct documents. Did they send the I130 back to the states recommending that it be revoked? If not you might not have a long wait. What did the paper that the Embassy gave him say?
