worried about our affidavit of support I-314

hi everyone. me and my fiance just recently found out that we might not be able to reach the 125% poverty guideline. we're both not experts on this process. here is our situation. we're applying for k-1 visa and we are on the response review stage. while waiting, we read here and in other sites to educate ourselves in this process. we came across the issue of the 125% poverty guideline. my fiance (the petitioner) is a divorcee, paying monthly child support of $676.00. he has 2 minor children not living with him. now, his mother whom he petitioned 5 years ago is the one living with him. she is working but she's not paying taxes. my fiance's (the petitioner) annual income is $27,000. as for asset he has only his 2000 year model honda crv and he will be selling his burial lots property in las vegas and will be paid $5000. there is already a buyer.

we would like to ask any advice or any helpful information whether or not we are qualified for the I-134 and do we reach the 125% poverty guideline? since, our household size will be 5. pls help us. we're are very worried. :help:

Umm, they go off his income tax return...so what does it say there? Dont worry about what he pays out...they dont go into detail on that.

for him to pay that much in child support he has to make more than 27000 a year...trust me I know.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Did he petition for his mother? Is she a US citizen now?

thanks for the quick reply. i don't have the copy of his income tax return yet. but i'll ask him what the form says. yes, that's the reason we're kind of worried. he needs more.

Did he petition for his mother? Is she a US citizen now?

yes, he petitioned his mother. she's a greencard holder not a USC.

on his income tax for this year, he only included his mother. his two other children were included in his ex-wife's income tax. the court decreed that they can have alternate year on which they can include their 2 minor kids in their income tax.last year, it was my fiance's time to include his 2 kids. and this year, it is his ex-wife's time.

Why isn't his mother paying taxes?

i can't answer that. i don't know the real details on this. but i met and talks with his mother. i didn't have the courage to ask her about her work. she's already 71 years old. she's been on my fiance's income tax every year for all the years she's in the US.
