Hello everybody , i need an advice .My relative is a green card holder ,he has been absent for 10 months because he is the student in Moscow and graduating next year, the problem is he will only be able to come to US for one week , i know if i apply I-131 re-entry form , i wouldnt get biometric appointment within a week , so the question is right before he actually flies here , can i file the form for him ? ( maybe 2 weeks in advance ) ?

P.S: I have a bad experience with local ASC , i know they wouldnt take his fingerprints without actual biometric letter.

Why must he come for only one week and why must he be gone for more than 12 months? If he is not absent for more than 12 months he does not need a re-entry permit.

To answer your question directly, yes HE can appy for a re-entry permit and most, but not all, ASCs will allow you to do a walk in biometrics if you have the receipt for filing the application (I-797) You can also apply when he is here and specify for the re-entry permit to be sent to the Moscow consulate.

Personally, I would explain to the young man that he WILL return to the United States and he WILL stay here as long as possible. He WILL return the day before his classes begin and he WILL come back here the day after his classes end. Send him the plane tickets in email. We don't have any grief from our son over this but we do not ask his permission or opinion, nor do we give "suggestions". We say "you are returning XXX date, here are the tickets"
