I-94 issue.

Hi everyone

well me and my fiance got married a month later when he arrived to U.S... he is here on a K-1 Visa.. well his visa is valid for 6 months but thats only for POE, if he didnt leave his country in those 6 months he wldnt be able to enter when it expires. Unfortunately, his I-94 expired and my question is whether that will make problems for the AOS.. i thought that date on the I-94 was only for the marriage and to get his social security card. He already did all that, we got married within 90 days, he has his State ID, driving permitt. I would like to know if any of you applied for Ajustamnt of status ( AOS) after your I-94 expired and did it make any problems? :/

sorry im asking this again...ive seen so many posts about this but i would love to find out whether any of you went through this OR if you at least know someone..

its fine,IF he entered US within the 6 months,and IF you got married within the 3 months limit,and want to apply for the AOS AFTER the visa has expired,it counts as over stay which will be forgiven because he married a US citizen.there are people who go up to a year or two without adjusting status

well no i am not going to wait that long to apply for my AOS... haha i am just waiting for our marriage certificate go change my last name and apply for AOS, ...i know once you change your last name i will be receiving a new social security card but the SSc number stays the same.. do i really have to wait for that new SSC card to send my AOS..i dont think so because number stays the same and they will already have it in the system my new last name...again i will appreciate any ideas.. i may be wrong... also my fiances birth certificate was taken at the embassy and he has a regular one here .. in serbian... :( i wonder if i can translate it somewhere in US or maybe have his mom pick it up and scan it n send it over email ..bcuz i think all they need is a copy

No, you do not need to wait for the new SS card to file AOS. An SSN is not even required for filing AOS. You only need a copy of the birth certificate, and a translation of it to send in for AOS. You should be prepared to have an original one for the interview though, in case you get one.
