My fiancee are about to get married and file AOS I130/I485 next week.

We have inconsistencies in her government documentation.

Here's the situation, using fictitious names vs. real names:

  • Fiancee's father's surname is BIANCHI
  • Fiancee's mother's current surname is RODRIGUEZ BIANCHI
  • Mother's surname at time she gave birth to my Fiancee was RODRIGUEZ GOMES

1. Birth Certificate - Mother's surname is incorrectly RODRIGES GOMES, Dad's surname spelled correctly BIANCHI.

2. Fiancee's expired passport in which her current B1/B2 Visa attached - Her surname is spelled *correctly* i.e. BIANCHI RODRIGUEZ; the B1/B2 is spelled the same way, so they are consistent

3. Fiancee's I94 has her surname truncated BIANCHI, R.

4. Her current passport shows her surname misspelled BIANCHI RODRIGUES

So basically there are 3 variations which are all clearly similar but between birth certificate, the B1/B2, the I94 and current Passport, they do not match.

Her "Personal #" (Venezuela's "SSN"-like number) is clearly & consistently stated between the two passports, and B1/B2 lists her passport number. So there is a link between her B1/B2 and her Passport.

We get married next week. We put on marriage license that her new surname will be her Father's surname hyphenated with my Surname (again fake for the example) "BIANCHI-LAPORTE"

So, she will have a married name that does not match any of her other names.

1. On the I130, I485, etc. what surname should we use for my Wife? BIANCHI-LAPORTE, or BIANCHI RODRIGUEZ...?

2. In the application packet, how should we go about explaining the inconsistencies in her birth certificate, and her 2 passports?

3. I'm assuming that this is not a showstopper for submitting the application with expectation of approval, but keep me honest.

You can always explain it in a seperate piece of paper, if they needed something they will send u rfe, when I filled our my i485 there are some stuff there Im not sure so I explain it on a piece of paper along with the corresponding number. Good luck on ur aos

When I apply for my aos I used the name that I have on my documents, my passport and birth certificate coz I wan not sure what to put there so I put my maiden name, when I had our interview I request that if they can put it on my married name, during the interview the officer will go through ur app and ask if everything is correct and she did made some corrections on mine like she change the name to my married name, on my birth certificate my moms name is spelled with a u instead of o but I told that they mistype it and o is the correct one, I also put single on one of the app and she ask why I did that I said coz it was asking for passport info and im not sure if they are asking my status when I arrived so I put single and she correct it and put married. like what ive mentioned above its important to explain it in a piece of paper if there is something ur not sure.
