I filed the petition for the K1 visa about 3 months ago and just found out tonight about the J1 visa conflicting with the K1 visa. My fiance has not completed the 2 year stay in his home country and were wondering how to get this waived so he can get the K1 visa. Has anyone else had this problem or knows how to help? I feel so brainless for not realizing this early. Please if anyone can help it would be GREATLY appreciated! Thanks in advance!

thank you. i think i may have it figured out! :)

I am in shock because I did not know this was an issue. My fiance and I filed our I129F on March 2nd and we have been expecting our NOA2 any day now. He had a J1 visa last summer. What are you going to do? File for an exception? This is such terrible news.

Not all J-1 visas fall under 2-year home residence rule.

Ask your fiance to check his visa - if it says on it "TWO YEAR RULE DOES NOT APPLY" he's good to go :)

Yes, thank you so much! His visa does say this. What a relief. I cannot stop smiling now :)
