Form G-28, what is that?? should we sign it?

Hi all my beloved VJ Friends..

My husband met an immigration lawyer yesterday, to consult all the requirement to filed petition I-130 F2a. i told him no need to go to lawyer but he was resistant to met the lawyer for better save. and the result from that meeting is almost the same like i was told him about the req doc to submit I-130. but 1 thing different, the lawyer said no need to make a cover letter for that petition, all he need is to sign Form G-28.

What is Form G-28 for? should we sign that? :bonk:

and after we sign that form, what will happen? :help:

Form G-28 assigns the attorney as your representative with USCIS. Thereafter, the attorney will receive all correspondence from USCIS and NVC.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

G-28 is the form that says you authorize a lawyer to represent you in filing the petition. Once you sign it, you have just hired that lawyer. How much will he charge? Does he have a track record with K-1 visas? Do you feel you need a lawyer?

We used a lawyer just because I felt it showed we were more serious about the whole process (and I had not found this website yet). Ours was a straight forward application and we were approved in 86 days and had the interview about 3 weeks later and she arrived about 3 months after that and the AOS was just completed. For the removal of conditions and naturalization we will be doing that ourselves. Some say forget the lawyer and save your money. I tend to agree with that and had I found this website before we filed I might not have used a lawyer.

Good luck on whatever you decide, but make certain you know the fees and what he will do for you up front.

the lawyer only charge him $100. my husband said, this lawyer is from government immigration services, so they know exactly about all this petition.

Did the lawyer say that they currently work for a "government immigration service", or did they say that they worked for a service previously? There is no "government immigration service" that provides this sort of assistance to people filing petitions, but there are plenty of former USCIS employees who work as private immigration lawyers or specialists.

If you sent a G-1145 then you'll probably receive electronic notifications about your case, but your lawyer will receive all of the mailed correspondence from USCIS.

Did the lawyer say that they currently work for a "government immigration service", or did they say that they worked for a service previously? There is no "government immigration service" that provides this sort of assistance to people filing petitions, but there are plenty of former USCIS employees who work as private immigration lawyers or specialists.

If you sent a G-1145 then you'll probably receive electronic notifications about your case, but your lawyer will receive all of the mailed correspondence from USCIS.

hi n4th4ly4,

did you finally go ahead with the G-28 filing and the attorney? if yes, who received the NOA2, all three of you or only attorney?

at the beginning my husband use lawyer service just to fill the form, and the lawyer attach G-28 too. but we also attach G-1145, so USCIS gave us info when we got approved. they emailed to my husband email address. but after our case in NVC, we sent email to NVC that we fired our lawyer. so they sent all information about bills and etc to my husband.

how bout your case? hopefully everything good.

A $100 to file the I-130 and be the attorney on record. That seems like a very low amount. Are you sure this person is actually a competent lawyer?

US government lawyers can only have one client; the US government. US government lawyers cannot work for private individuals. It would be absurd to let a US government lawyer represent a private individual in a matter in front of the US governement.

Either you mistaken that he used to work for the US governement and is no longer doing that, or he lied to you.

im not sure about complete info about this lawyer since my husband who's the one dealing with this lawyer, but my hubby said, he just paid for 100buck to ask the lawyer fill out the form, guide him about the petition I-130..

all we know, actually lawyer cant do anything much for us to get approved by uscis or nvc rite?? so, at that time my hubby just not sure how to fill out the form and first step of applying I-130. and he said this lawyer is competent enough to help him.

after my hubby sent petition on july 2011, nothing else that lawyer do for us. we follow up by our self to uscis. but when our case got approved, USCIS emailed to my husband email address and also the lawyer email address.

since we sent G-28 before, so NVC also process our docs, sent it to our lawyer, we got both bills AOS and IV. and NVC didn't ask for COA.

but we decided not to use lawyer services anymore, so we fired him and sent letter to NVC about it.

so basicly, what our lawyer did was just to help my husband in the beginning. that's it!

for me, it is soo ridiculous to pay a lawyer for 3k-5k only to fill out the forn, make some phone call, and do small thing that actually we can do it by our self, all we hv to do is browsing more and do research more about this whole tiring process. sleepy.gif

am still waiting for noa2 and we hope to receive it soon. could relate to your initial process, hence posted a query. my spouse also wants to be very careful to take all precautions, and that is why was very particular about speaking to an attorney :).
