[Apologies for the cross-post from the Canada forum, but it was suggested this is a more DCF-specific question]

Quick background: I've been living in Ontario since 2005 on a Student Visa (expires in November). My Canadian fiancee and I are marrying in the US on July 15. Then I'm moving from Canada back to the US on August 1 to start a new job. The idea is to DCF as soon as possible after July 15 once we have our marriage certificate. But very soon afterward (Aug 1) I won't be living in Canada anymore.

So this is my question:

On the I-130 and G-325a we send to Toronto, should I list my new US address (as of Aug 1) as my current address? -- or will that disqualify me from DCF, since it would appear that I no longer reside in Canada?

Technically, of course, at the time of filing I will still reside in Canada, but I'll probably be living in the US by the time anyone at the Consulate contacts us.

Would it help if I attached a brief cover letter explaining my impending change of address?

Also, one bonus question: The instructions for the I-130 say the filing fee must be a money order drawn from a US bank. How do you get a money order if you DCF in Canada?

You can get a US dollar order at any Canadian bank and it will be fine. I'm not sure about the rest so I don't want to answer and be wrong :unsure:. Good luck however it turns out!

I noticed you said "send off", so it is true then we DCF via mail to Toronto? Thats what my research has been telling me but I just always assumed it would be done in person.

As for your question, you can get the money order at a canadian bank, just in US funds. For your address, I would put your current Canadian address, however I DO NOT KNOW if this is the correct thing to do, just a hunch.

The petition gets mailed into Toronto. They will then call you in to show them all the original documents that you submitted with the petition. Once you meet with them, they then send it to Montreal where the rest of the processing is done.

Hi everyone -- after lots of phone calls and emails I finally found an "official" answer to my question. I got through to the Toronto Consulate and they told me explicitly that I must be residing in Canada at the time of my initial appointment at the Consulate (which would occur sometime after they received the I-130 petition in the mail). It doesn't matter how long I have been residing in Canada before that point if I no longer physically reside in Canada at the time of the meeting.

Unfortunately that disqualifies us from DCF, since I would be living in the US by that point, so I'll have to file the petition from within the US once I move in August.

Hi all,

Does anyone know how to actually through to the Toronto consulate? we submitted an I-130 nearly a month ago and I was kind of hoping the follow-up interview from document verification would be sooner rather than later. Is it possible to phone them and ask about the status of the application? Does anyone have any recent timeline for a DCF toronto I-130 application?

Yeah, but the consulate in Toronto has an obvious public counter presence so that would imply that I can still file through them.

Sorry, you are right. There's no "field office" in Canada. Well then what did they do with it,I wonder? When I applied I just followed the direct instructions on the Toronto consulate's website and then sent it off. They received it the 26th I think, so after the deadline, but I know that the website was still claiming you could send it in at the time. I hope they didn't just forward it to Chicago lockbox and now it's stuck somewhere...I emailed and will see what if anything they say, but this is just plain bad luck at this stage.
