changing from a K1 to a CR1

Hi everyone,

I was just wondering if anyone here has already done this or maybe heard of some one doing this. But after the problems the embassy is giving us on her K1 i have beed concidering just going there marring her and changing to a CR1 instead. I can use some advise. I was wondering how easy it is if there are addtional fees involved addtional waiting times? do i need to reapply through the vermont center and start all over again? Any advise will be great.

If you do this, you will start ALL OVER from the beginning again.

CR-1 forms bottom of the pile waiting almost a year. CR-1 fees etc.

You cant "change" your petition into another petition and sit at the same spot. Its a whole new thing with new paperwork sent starting all over.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

you can withdraw the petition, you won't get any refund thats lost,you can call the 1-800 number, and send a letter to the address you sent your 1-129f, get it notirized with mail confimation,you want to withdraw, the 1-129f- k1 petition,then when married file the 1-130 cr-1 another fee 420.00 good luck

You are almost there. She is in administrative review, she could get her visa anytime. Just hang in there.

Do you know of any red flags in your case? For example how you met, past association with her family etc...

From what i am gathering the problems lie in the way she answered her questions. She may or may not have made the mistake when she told them she was coming here to marry and find work. the other problem could be is that i have not been back there in two years. I sent them everything i have. bank statements, phone records,chat logs, postal receipts. But still they are not satisfied with the relationship. So now the file goes back to vermont center to be reviewed.

It's hard for anyone to say, but my advice would be to wait. How long has it been since her interview? Has anyone TOLD you why it is being sent back to VSC? After getting this far, I would wait to see if you are denied before trying a CR-1. Hopefully whatever is causing the delay will be resolved, and you will be on your way again after this delay. It would really suck to get this far, send your letter of intent to cancel, then have your packet approved at the last minute...

What she was told is that i need to convince them. on her 221g the COo stated that he felt she would not marry me. and he checked the box to have it sent back for review. i am hoping that once it goes to vsc i can get a chance to talk to them.

If you haven't seen each other face to face in the past 24 months you need to go and see her again. That's one of the K1 requirements.

i disagree. the only time it says anything about meeting in two years is when you file the 129. we did that. it never said any where that after the papers are approved and go to the embassy that we need to meet in person again. we had an agreement that the next time i was there was to bring her home to me. it just happened that she ran into a lot of problems with getting together her info and passports.

In your other thread didn't you say you'd got the embassy in Manila to keep the case file there and review it with the new evidence you sent them?

Technically you're correct the I-129f requires that you have met in person within the 24 months prior to filing it. But (and this is a very large but), the CO has expressed doubt in the reality of your relationship. It would be difficult to imagine the CO isn't wondering how the relationship is real if you haven't been back to see her. You need to remember that the CO has discretion and apparently this one has enough reason to doubt the relationship.

Want to prove the seriousness of your relationship? How soon could you get on a plane to Manila? If the case file is still at Manila, contact them and tell them when you'll be in town. Let them know you want to see the CO so you can address their concerns in person. If you can hang around for a couple of weeks you just might not be alone on the return flight.

MY COUSIN RAN IN TO THE SAME PROBLEMS 7 YEARS AGO.... HIS NOW WIFE FAILED HER INTERVIEW AND WAS REJECTED THE K1 VISA. HOW EVER HE FLEW BACK TO THE PHILIPPINES AND MARRIED HER CAME BACK TO THE STATES AND FILED FOR A K3 VISA... I DON'T KNOW THE PROCESSING TIMES FOR VERMONT HOWEVER FROM OTHER FRIENDS AND FAMILY MEMBERS WHO HAVE FILED FOR A CR-1 VISA INCLUDING MY SELF IT IS TAKING ON AVERAGE 7 TO 9 MONTHS FROM START TO FINISH GOING TREW CSC... IF YOU MARRY HER AND FILE FOR A CR 1 YOU WILL SADDLY HAVE TO START ALL OVER... SO YOU WILL BE WAITING ACCORDING TO VERMONTS PROCESSING TIME FOR THE CR-1 PENTITION. ONCE IT GETS TO THE NVC HOWEVER THE TIME SHOULD GO FAIRLY FAST. ONCE YOU HAVE THE MNL NUMBER YOU CAN THEN SEND THE CHOICE OF AGENT BEFORE YOU EVEN GET NOTIFIY BUY THE NVC ONCE THAT HAPPENS ITS ONLY A FEW DAYS TO GET THE AFFIDAVID OF SUPPORT BILL AND INSTRUSTIONS FOR IT.. THEN ONCE THE PAYMENT FOR THAT IS RECIEVED YOU WILL GET THE IV APPLICATION PROCESSING FEE BILL AND INSTURSTIONS.. THEN YOU WILL MAIL THE FORMS OFF IT TOOK ME ROUGHTLY 14 DAYS TO COMPLETE THAT PROCESS "I MESSED UP THO AND SENT THE PHOTO COPYIES BUY MISTAKE INSTEAD OF THE ORGINALS" RFE ON THAT... ONCE I RECENT THOSE I GOT THEM APPROVED IN AGAIN 14 DAYS... THE PAPER WORK IS SOME WHAT THE SAME.... FORMS YOU WOULD FILE ARE ... I-130 , I-864 - IV APPLICATION FORM, AND CHOICE OF AGENT FORM... YOU WILL PAY THE CURRENT I-130 BILL WHEN YOU MAIL TO THE LOCKBOX YOU WILL THEN PAY THE AFFIDAVID OF SUPPORT FEE OF 88 DOLLARS THE IV APLICATION FEE OF 404 DOLLARS.. THEN THE MEDICAL FEES AS NORMAL AND LET THE PAPER WORK TAKE ITS PROCESS THEN 90 DAYS PRIOR TO HER 2 YEAR ANNAVERSRY YOU WILL FILLING I-751 AND ALL FEES WITH THAT AS WELL.
