I need some advise. Here is my situation. I filed for bankruptcy about 3 years ago, because I had alot of medical bills (some pre-existing conditions)everything was discharged, and now I have 2 1/2 jobs now, sent copies of all 3 of my W2's and also letters from my jobs telling how long I have been employed, but my fiance was denied because they said tbat I filed bankruptcy and they cannot see how I can afford to travel to see him as often as I have. I don't have any children and made close to 50,000 last year. Has anyone been denied for filing bankruptcy, and if so what did you have to do

I have no idea about bankruptcy specifically, but if they are not satisfied with your finances, the most straightforward way might be to find a "Joint Sponsor"

Married Jan 2009, Filed Feb 2010. Initial petition denied August 2010 due to legal technicalities. Refiled---

First off, how did they find out about your bancrupcy?

I was thinking the same thing. There isn't anything that asks about credit issues. So I'm not sure why they would use that reasoning for a denial.

Lots of denial coming out of Kingston lately...Must be a new CO in town, the comment ":but my fiance was denied because they said tbat I filed bankruptcy and they cannot see how I can afford to travel to see him as often as I have.." doesn't make sense.

Did they give him a 221 form, or a straight out denial?

Something doesn't sound right, T&J - I have never heard of a past bankruptcy causing a denial of the petition - Especially one that was three years ago, and you make over the limits since - Plus, if the financial reasons were the reason for the denial, they typically would give your fiance a blue slip to return and ask for a co-sponsor.

Have you emailed the embassy at all to see what they said? Did they give your fiance anything at his interview?

There are people all the time on VJ that talk about their bankcruptcy all the time and their visas are approved. Maybe it was the circumstances surrounding it, or maybe you have again accumulated debt?

No, but I just pulled my credit, and my some of my sister's information is listed on my credit so I wonder if they they think it is me, so I am going to have to get that clarifed before I reapply.

Even still...something just isn't right about this. People on VJ file sooner than your timeframe all the time. And they're getting approved. I was just poking around on the forums. I think you got someone having a bad day. If you required another co-sponsor, they would have explained that at the interview too. People are posting daily that the CO told them you need to show more stable support. You will need a co-sponsor. You will need to look at that paperwork and get some answers from them.

Keep emailing them - Put third request, etc.... in your reference line - the squeaky wheel is the one that gets the oil.

Also read through some of the other JA threads in the past week - there are a few others dealing with similar.

I am curious about your timeline - it says you had an interview 6/14, then a second interview? What was the second interview for?
