I've been reading about the I-94 specifically with regard to questions on the I-485 (Part 3A - Place of Last Entry, Inspection, Status, etc.), I-130 Q 14, I-765, et al.

My husband's I-94 only reflects the date in October when he was granted his P-1. Since then, he has left and returned to the US twice. We have no record of this. He drove back and forth over the land border between NY and Canada. He was questioned (not secondary), but nothing was requested of him and nothing was given to him.

I've read that when leaving the US to Canada, your I-94 does not have to be surrendered, which is good in this instance because he never surrendered his, but how are his exits and entries tracked?

Is this a problem? Which date do we put on his paperwork for Date of Last Entry? If there is no record of him exiting and entering other than the date on his I-94 (October) and we indicate that he last entered in June, will this be an issue?

Just from personal experience....I had an I-94 for going to school. I really didn't know much about having to surrender it. So I go home, cross a few times during that summer (after graduation), and one border guard really looks at my passport and sees I still have the I-94 and gives me a piece of his mind about having to surrender it, yadda yadda yadda. I was a bit scared. I said "I'm sorry! I honestly didn't know/wasn't told!" He ripped it out and oh so lovingly (lol) gave me my passport back.

My advice, surrender it before you get a border guard in a cranky mood. :bonk:

Thanks for the quick replies. I'm glad that they are familiar with canadians not having an I-94 record; I was really worried that we did something wrong that would derail our (soon to be submitted) application.

Thankfully, he wont be crossing on his P-1 any longer as we have decided that we need to move forward with the AOS to perm resident. We've certainly run into some real doosies while crossing the border together!!
