My last resort to reopen my case is through joint motion to reopen. My lawyer filed a joint motion to reopen to the DHS attorney 2 months ago which got denied(cannot join in the motion to reopen).

My question is that can I appeal this decision and who do I appeal to, the DHS attorney or BIA?

No decision on a motion to reopen can be appealed. You can file another motion if you can find a new basis for it.

05/01/2013 - Removal of Conditions - APPROVED!
