If u file for adjustment of status ..it should be mentioned @ ur i130. I would say..u r not receive any case number from NVC. Just need to wait for PD to be current to file for I 485.

AND MY PRIORITY DATE IS OCT 1, 2010.. WHATS WRONG? WHEN I CALL NVC ALWAYS SAYS " THE VISA IS NOT AVAILABLE U NEED TO WAIT UR PRIORITY TO BECOMES AVAILABLE. THEN WHY OTHERS GOT COMPLETED AND PAY FEES, DATS NOT FAIR, RIGHT?

Believe me even if others got their cases compleeted it doesn't necessarily mean they are getting interview tomorrow an greencard next week, they will also have to wait. We all have to wait!!!..

For all those anxiously awaiting next PD release date or interview notification - Write to CIS Ombudsman. I am not claiming it is a fix all, but we need to make our voices heard to ensure USCIS/DOS releases its demand for the visas to prevent guesstimate month over month. Below is the response from CIS Ombudsman on my attempt to communicate

Dear XXXXXXXXXXXXXXX,

Thank you for sharing your observations with our office. You are correct that currently F2A applicants must make a guess-estimate on wait times based on current priority dates and it would benefit applicants to have access to more information. Under the authority of the Homeland Security Act of 2002, our office assists individuals with specific problems during the USCIS benefits seeking process, largely to identify problems and to formulate recommendations to improve the USCIS service. Input such as yours is the best source for identifying systemic problems in the immigration benefits process. Our office will consider the information you provided as we develop recommendations to improve USCIS’ practices and procedures.

Sincerely,

The Office of the Citizenship and Immigration Services Ombudsman

Subject: Demand Data for Family Immigrant Visas

First off, I would like to thank CIS ombudsman for being an intermediary to establish link between the visa beneficiaries and the USCIS and Department of State.

I understand there are lot of rules and regulations governing the movement of priority dates based on numerical limits. As a legal immigrant with a pending application (F2A India), I would like to appeal for more openness in publishing the demand data for family based immigration as well, much like DoS does for EB category. This would be immensely beneficial especially with the retrogression of priority dates with numerical limits so as to anticipate the wait times and all life altering decisions such as marriage, or the matter having kids.

I had applied for F2A visa (I130 pending, PD May 2011). With the F2A movement and Report of Visa Office 2010 (http://travel.state.gov/visa/statistics/statistics_1476.html) suggesting a total of 910 visas issues in FY 2010 by both consulates and USCIS (I485), I would assume, the current priority date to be near close to the current date as opposed to 3yrs of retrogression. Without the details on demand data, it is hard for beneficiaries to determine how long the wait time is as, even the CIS Ombudsman report citing 2.5 yrs wait time in Jan 2011 and even in July 2011, there seems to be little progress.

Perhaps with the demand data for family visas, it may be clear as to why the priority dates are retrogressed when numerical quotas of F2A is not even meeting the numerical limits.

Thanks

That was great Kumbahara, what I understand from his response is that they are responsible for USCIS complains/rules. I think we need to ask the same question from NVC or visa office as well, why they are not releasing the data in terms of how many applicants currently waiting per year. Another important question would be why they do not use all available visas approved for F2A. I am sure if they use all accumulated unused visas during previous years, the VB for F2A would be current by now.

Here is my question from the forum members: is there any email address or communication path that we can ask those questions from NVC/visa office?

Thanks. As I understand NVC is also managed by USCIS. So I guess CIS ombudsman is the place to contact for issues with NVC, where one cant get straight answers.Beneficiaries can contact CIS ombudsman with specific issues with delays if it exceeds normal processing times as well. CIS Ombudsman releases annual reports and also comes up with recommendations that gets submitted to congress and I believe last years PD movement was a byproduct of CIS Ombudsman report on USCIS wasting family visas.
