can i get green card with k1 visa?

hi everybody,

i came to the US on august 2006 on a K1 Visa,

i got married my K1 petitioner within the 90 days after She abused me i was subjected to violence( i had picture about having subjected to violence).At that time,i divorce with her and came back my country after 6 mouths. I got my social number card and i did everything for having a green card but didn't take it. Now, i am a business man,live in turkey and i would like to live in america with my familly.Can i get my green card? would you help me about my case? thank you..

Sounds like you did not file for adjustment of status and abandoned your residency. Is that correct?

thank you for replying my msg...yes it is correct... i abandoned my residency but i did all procesess ... i don't know certain but after i came my country my ex wife said to me my green card was ready but at that time i didn't care it ...what can i do in my case?

Nothing, you have abandoned your GC, when you left the US 5 years ago. Continue to live a good life in Turkey with your new wife and kids.

You cannot restart where you left off. That green card eligibility ended when you left the US 5 years ago. Even if the GC was issued it would only have had a 2 year duration at which point you would have had file for removal of conditions. That time passed a few years ago.

Sorry to say, but you have no claim to residency at this point.

Here's the deal. Someone who is married to a US citizen and suffers abuse from their spouse while in the US can file for adjustment of status based on a VAWA petition. It is possible to file the petition while the alien spouse is outside the US. So far, so good. The bad news is that you must either still be married to the abusive spouse when you file, or if divorced then it must have been less than two years since you divorced and you must prove that the abuse was a primary factor in the divorce. You must also not have remarried before the VAWA petition was filed.

Based on what you've said, I don't think you have any basis to gain permanent resident status in the US based on your prior marriage.
