Sending AOS packet without Civil Surgeon Document?

My stepson will arrive soon on a K-3, but we have very little time to get him processed for his AOS before he should return to his university in the beginning of September in St. Petersburg, Russia. Is it possible to mail in all of his AOS documents the day he arrives, and send the document that the civil surgeon will prepare later after that is completed so as not to hold up the process. We would like for him to get his case number ASAP so we can try to get him a quick biometrics appointment and Advanced Parole. Thanks.

Your step-son will be arriving with a K4, unless he's married to a US citizen.

USCIS will usually send an RFE for the I-693, but I'm not going to promise they won't reject the application for it. There have been other VJ members whose applications were rejected for something that many other VJ members got RFE's for. The upside is that they won't cash your check if they reject the application. You can just include the missing document and resubmit it. The downside is that it will set you back several weeks.

He won't need advance parole if he's got a K4. It's a multiple entry visa. However, if he's scheduled for an AOS interview then he must attend or his AOS will be denied.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

OP, are you sure you don't mean K2? Perhaps a follow-to-join sort of thing?

2/06/13: APPROVED!

AP takes about 2-3 months to be processed. You could try to expedite it, but if there is an RFE for the I-693 they will most likely not grant the expedite until its completed.. So its a risky gamble. Either way you are under great time pressure. I wish you luck

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

If he is arriving on a K-2, part of the visa process was submitting his medical at the embassy. That should have already been done. It is required for the visa to be issued. Once here, to get a qualified civil surgeon to sign off on his papers should only take a few days. Send all of it with your AOS. You can apply for his AP and EAD at the same time as his green card. Be aware, that once he gets his AP, he can travel back to Russia, but once he gets his interview date, he MUST come back ASAP. You don't want to miss this date or play games with it. You miss the interview and it is very possible his AP will be canceled and he will not be able to return without a lot of hassles. BTW, you don't mention his age. I hope he ARRIVES BEFORE he is 21.

We are hoping to do an infopass after he receives his case number in hopes that our local office will issue him an AP early, since he has a good reason to need to leave the country and because the AP will already have been paid for. We will probably also request to make a bio-metrics appointment to be sure it is completed before he should leave.

Sorry if I am not writing clearly. I should have said that we will request an "early" biometrics appointment so that can be out of the way. Thus, if he has an AP in hand when he leaves, he can return for any reason (including an interview) if it should be necessary. Yes, he can return for an interview if they request it - since I will be footing the bill for the airplane ticket :-)

If they request an interview, it will be after biometrics and most likely after he receives AP. Will he be able to return for it?

As for your original concern, find a civil surgeon before he comes and schedule his appointment as soon as possible after his arrival. That way you can send his AOS packet off a few days after he arrives. RFE for missing shots will delay you for weeks and until you respond to RFE and they process it, all your applications, including AP, are on hold.

If he completed all required shots before or at his medical in Russia, then he doesn't have to see a civil suregon.
