Hey guys. Need advice badly. It refers to my earlier post:

So I put a stop payment on the check and decided, just to be on the safe side, call the immigration and tell them that I filed a wrong form and put a stop payment on the check. I did not give them my info, just asked how to proceed with the application.

The lady said (she seemed nice) that if I do that the immigration will still invoice me for the same amount I filed plus there will be more charges. That's just insane. My husband is calling them again now to speak to another agent to see whether they'll say the same thing.

Thing is USCIS in Arizona haven't opened my application yet. It's gonna be delivered today. My application is not pending, nobody has put any work into it.

Do I understand well that, if they realize, it is a wrong application, they might send the whole package back?

Don't think there will be any additional charge - your petition just won't get processed and that's what you want. You may get a notification saying they won't do anything until you send another form of payment, but just ignore that.

Thanks but I should have filed a different form to a different office - California, not Arizona. I spoke to one lady, my husband to another and they both confirmed that putting a stop payment on a check results in USCIS invoicing you anyway plus additional charge. Maybe they are supposed to say that, they want your money after all.

Anyways, am trying to intercept the package. It hasn't been delivered to USCIS yet... Wish me luck

Filed I 90 instead of I 751 to remove the conditional residency. I 90 you send to Arizona, I 750 to California. The USCIS in Az got the package which I tried to stop through USPS, to no avail. Question as follows: Can I count on getting the whole package back, together with the check? The application will be rejected cause I used a wrong form for my case. I put class of admission CF1, which pertains to conditional residents.

FOLLOW THE INSTRUCTIONS TO WITHDRAW YOUR I-90. That involves sending a request via the mail.

Thanks. I know I can withdraw it any time. I am just worried that if I send them any form now, they will not send the payment back. They clearly say on their site that no withdrawals/cancellations are subject to refund.

Am thinking about a different scenario. Leave it as it is, they will figure out they got a wrong form and will send the whole package back. Was wondering if anybody had a package sent back together with the payment.

This is why its good to use UPS or fed Ex they can actually stop delivery of your files before it reaches USCIS and send it back to you

LOL, another expertise of USCIS customer service! they suck in giving information. i dont know if they intend to post those useless CS to answer queries...theyre totally a waste of timeheadbonk.gif just cancel the cheque they will return your packet then you sent it back with the right form.
