Working after 90 days Temp EAD

Hi All,

I remember reading somewhere that a VJer worked after the 90 days expiration of their temp EAD that they received from JFK. I can't seem to find the post. I remember that there was some debate as to whether it was necessary to stop working if the 1 year EAD had already been filed and you were waiting for approval.

Your Employment authorisation ends with your temp EAD.... you will not be authorised to work again until your 1 year EAD is approved...

So the answer is you are ment to stop work until you receive the new EAD...

Well good luck with that... all I can say is that the vast majority have been told that as the 2 EAD are not linked and until the 1 year EAD is approved you are NOT authorised to work... but I guess it come down to how much you are willing to risk...

Well stated - one is meant to not work once their employment authorization has expired, until they have been given new authorization (or renewed authorization, as the case may be).

Further, the employer has a responsibility under the law to keep track of its employee's EA status.

That is a bit different from the way that shayrene stated the situation! Each person can decide for themself how they will handle the subtle difference if the employer does not fulfill its responsibility.
