I am working on my husband's AOS. The forms are fairly easy to fill out but I do have some questions about the Affidavit of Support.

Part 6 #23 - I work at the school and am currently unemployed during the summer and receive unemployment benefits. Do I put what I made so far(Jan -July 2011) for my current annual income or do I estimate my income for the 2011 year? According to the step-by-step instructions I am not required to submit evidence for this part. However, I am required to submit last year tax return or transcript. Is this correct? Is that the only evidence I am required to send? Also are the income requirements are the same as when I filed the petition?

Thanks.

You're supposed to estimate what you will be receiving for 2011 per your employment. You also need to submit three yrs tax transcripts as well as a letter of employment and paystubs from that position. How soon will you have to send the 864 in? if it coincides with you working again in the fall then that should be fine but if your unemployed at the time you sign and submit then you're unemployed. Do you have a contract for the school position to come back in the fall?

Yes I will be returning next month. But we want to go ahead and get the process started because my husband wants to start finding work as soon as he gets his work permit. I may have to have my employer write a letter stating that I will be returning to work in August. I do have a co-sponsor, which brings me to another question. Will they have to fill out I-864A?

Thanks.

Im not familiar with co sponsors... altho we may end up having to have one... but from what i understand they would fill out an i 864 ...they fill the i864 A out i think only if their income is being combined with their spouse or other household member who would be the actual sponsor

so unless they are your household member they would fill out i 864....

If you live in the same household, then your co-sponsor could use the I-864a. If they do not live with you, then they fill out their own I-864, checking the box for being the only joint sponsor.
