My fiance is here on a student visa to go to college. He has had some fincial difficulties and unable to find work. He is suppose to register for classes by Aug. 22 but owes the school money and doesn't have money to pay for next semester. We plan on getting married Aug. 13th. My parents are willing to help us pay the fees for the I-120 and change of status forms. But we need time to get all the required documents for the change of status and don't want him to get put on a SEVIS from the school for not registering for classes. What should we do?

How long do we have to file before he is in trouble. We plan on getting married on August 13th and school is suppose to start August 22nd and he will not be registered for classes. We need some time for the marriage license to get to us and to get all the documentation and examination together plus money to send in so we would like to know how long we have before he would be in trouble.

Has he spoken to the DSO at his school? When I was on an F1 I knew of a girl who was able to delay the SEVIS report because the DSO knew she was filing for adjustment of status. He should probably do that

No he hasn't talked to his DSO we are afraid if we tell them they would report him sooner. Registration ends August 22nd.

Have him speak to his DSO for guidance. The DSO cannot report anything that hasn't happened.

I normally refrain from giving unsolicited advice, but I am going to urge you to think things through before you leap through anything. I came here on an F1 visa too, and know how hard it can be to get enough money to pay for tuition. I have seen foreign students who convince their SO to marry them in order to help them, and those situations never ended on a positive note for the USC. I have also seen plenty of students in worse situations who can & do survive without having to marry an USC. Did you know that your fiance can ask for a waiver to work off-campus and set up a payment plan with the school if he has trouble paying his tuition?

You need to let your fiance sort out the mess he is in right now before you marry him. You mentioned that he owes the school some money, and that neither of you have enough money to adjust his status. You are inviting a lot of financial trouble for yourself if you proceed at this point. If he can't find a job and pay his prior obligations, he can always go back home and you can sponsor him for a fiance visa.

I really advise you against marrying someone (USC or non-USC) to rescue them. Bad idea!

Thank you for your words but I am not marring him to save him I am marring him because I love him and so do my children. The school issues is that we can afford the wedding, the filing fees, his balance he owes and another semester of school. So he will take time off of school while I go back and finish my degree than he will go back. I talked to the USCIS office today and told them our situation they said that as long as he entered in good status and we are married and in the process of filing our paperwork we/he will be fine but to file as soon as we have everything together. He is still going to talk to his advisor at the school. We know there are other options but this is the option we believe is best for us and our family. Thank you all for your help.
