APPROVED!! But really worried about Interview. Help!

Hi, All -

Finally, my wife’s IR1 visa has been approved :D (After 5 very long years of being apart :whistle: , coz I had geerncard when filled I-130? She just received a letter from UK ebbassy with her Interview date (October 3rd). Her Medical is todaywhich she isn’t too concerned about, but she is really stressed out about the interview.

Reason why we’re so worried is because we were looking at DS-230 part2 and think we need to answer YES to Q32 - Have you ever been refused admission to the United States at a port-of-entry?

I’m wife has come over to the states many time to see me, but on her last trip over she got stopped the officer thought she was coming over to stay for good even thought she had a return ticket and planned to go back to London in few weeks. They ended up sending her back the same day and told her she need to wait for her Immigrant Visa, also stamped her passport with VWP (Visa Waiver Program) refusal. I think the refusal was due to her having photo albums and personal paperwork in her bags.

My wife is really worried about the interview only because of the refusal, and feels they may make a big deal about her getting the refusal at point of entry last year. If anyone can give us some advice it would be greatly appreciated, it may even help put my wife’s mind at rest which would be wonderful.

Should we be really worried about the interview coz of refusal? It would be really nice to hear from someone that has been (or is) in the same situation.

Met Bindu for the 1st time at School/College & ended up going to the same Uni (not planned). We fell in love by the end of uni. I had my greencard (via family since I was 16) and was about to lose it if I didn’t move to USA. Bindu and I decided we'd be better off in America so I moved to charlotte Nov 2000. We never imagined we be apart this long (5+ yrs now)… maybe we made the wrong choice, but I doing really well as far as work and we still love each other like crazy even though we only see each other 2or3 time a year…. thank god for telephones and internet. Its taken long time for our I-130 coz when I applied I was a geencard holder not a citizen. We’re hoping it will be all over soon (by August 4th 2006 my b’day, would be best gift I ever got) and Bindu and I will live happily ever after.....

Time Line -

11/20/00 - Moved to Charlotte NC from London on Greencard

02/20/02 - Married Bindu here in Charlotte (Small court wedding, big indian wedding planed for 2005)

I-130

6/25/02 - Filled I-130 for Bindu from Charlotte NC (Me still on greencard)

1/20/06 - I became US citizen

04/10/06 - I-130 - APPROVED by USCIS

NVC

05/05/06 - New NVC case numbers entered into system

It is my understanding through reading many posts on this subject, that it is very common during this process for spouse/sig others to be refused, and unless it was something more drastic (like frauding at border or misrep) just answer honestly and tell her not to worry. I assume she was allowed to withdraw and didn't get any kind of serious ban, and like I said, that's very common with spouses during the wait.

I have read tons on this, because my husband was refused entry in Toronto and allowed to return back home, allowed to withdraw. He has since visited US without issue (he came next time with piles of proof showing ties).

Married 12-30-05

Started our visa journey Jan 06.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

I-130

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-03-06 Packet 4 received

11-06-06 Medical

11-22-06 Interview / Visa approved

11-26-06 heading home, 6 day drive, my oh my

HOME SWEET HOME

10.24.08 - Mailed I-751 to CSC

Delivered at 9:03 AM on October 25, 2008

10.29.08 NOA1

10.30.08 Check cashed

12.06.08 Biometrics Appt.

12.19.08 Received new Drivers License extended to 2011

03.12.09 Received CONGRATULATIONS letter - Card on the way!!

03.20.09 Received his SHINY new card. WOO HOOOOOOO

YAY!! We can take a break from this madness until Citizenship.

Dont worry many prople have been refused entry.U have done nothing wrong its just that the officer thought that ur wife would not return hence he refused entry.

tell her not to worry and best of luck for the interview.

Thanks for the replies :thumbs: , its definitely given us some peace of mine. :D

She was able to return to UK, and withdraw her Visa Waiver without an issue. Infact the officer advised her to withdraw since if she didn’t they could deport her and cause issues. We think this was due to her having two luggage one of which she had photo albums, paperwork and other stuff which she wanted to leave here so she would have less to bring when she moved over. Big mistake!

Anyway I’ll tell my wife don’t to worriy about it too much and I'll keep my fingers crossed for a successful interview. We've been apart way too long for this to go wrong now. I’ll update this post with the outcome once she gets done with the interview.

You should be fine. Your wife should not bring this issue during the interview. But if she is asked, then she should answer truthfully about it (and of course about anything else).

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

This should not be a problem. She was probably stopped at the port of entry because many people misuse the system and try to find the easy [illegal] route to stay in the US instead of the much harder, longer [legal] process.

I still cant seem to comprehend the 5year wait that you and your wife have been thru!!! I cant even imagine myself going thru that scenario. Hats off to you my friend! :thumbs:

Hi, Everyone – I HAVE GOOD NEWS! My wife is finally here safe and sound. :dance:

I’m sorry for updating this post a little late, but I thought I’d reply and let everyone know everything went well with my wife interview and at port of entry. During the interview she did get asked got asked the normal questions plus a lot of questions about her refusal but she answered all questions truthfully as possible (as advised by VJ members). The interviewer did keep her wait for a bit to check with his supervisor, but everything was okay. The interviewing officer did tell her to accept lots of questioning at POE :o , but we really didn’t know if that meant that she could be refused at POE, so I got in touch with a immigration attorney in NYC just in case she had any issue at POE. After the interview she received her Passport with visa the next day. The attorney told us not to worry as she already has her visa, and as long as they don’t find anything wrong with the paperwork at POE she should be okay. He told my wife to call him if they give her issue at POE, but we were hoping (prayed every night) we wouldn’t have to call him.

She arrived in USA (JFK airport) last Wednesday, she was told to line up in the US citizen line and once she got to the front the officer looked at her passport and paper work and took her to another room (this is normal). She waited for about 15mins and then she was called up to the desk where the officer went through the paper work and asked her some basic questions like, how long have you been married? How long have we’ve know each other? How did we meet? He thought our story was sweet, he seemed like one of the nice officers. They didn’t even mention her refusal, I’m not sure if she just got lucky or what… but we were so glad she didn’t get grilled :D . From talking to the immigration attorney, he did say she shouldn’t have any issue at POE since she has already been given a visa in London, but you never know so we did have some sleepless nights.

Well anyway it’s all over now, and we’re finally together after a long 5yr wait… now looking forward to living happily ever after :luv: .
