letter of intent to marry.. need help please

hi all...

my fiance just submitted our application forms for the k1 fiance visa... we have put every necessary documents they need.. we actually used an immigration service for this..

so we just mailed the forms to the uscis in texas today, they will receive it by the 5th of July..

now when i was reading the USCIS website about k1 visa, they have there stated that one of the requirements is, A LETTER OF INTENT TO MARRY... and since we used an immigration servie, the website that guided us about all the application forms we need to fill out, didn't mention anything about the letter of intent to marry..

that is the only thing that we don't have ... is that necessary to have that? or the uscis will still accept our application since we have everything anyway except for the letter ofcourse..

Yes, that letter is necessary; expect to receive an RFE for them. Don't bother trying to send them separately now, it will not get matched with your file.

You both have to write one. You write that you are legally able to willing to marry the other person and intend to do so within 90 days of the beneficiary's arrival on a K1 visa.

You MUST include a signed letter from both of you giving your words that you are going to marry in the 90 days of the arrival of your fiance, that is what the Letter of intent to marry means. I hope you can get the sample for this site. Now what you can do is, wait until you get the NOA-1. when you get the NOA-1, copy it and send the letter together with the NOA1 to the service center. If they include it to the original petition, that will be wonderful. Otherwise they will send you RFE at that time you will send it to them. I send them a letter this way and worked for me. They matched my petition with the letter I sent to them and didn't get RFE.

It's one of the few requirements for the K1 petition. Kind of makes you wonder about the quality of the visa service that you paid to help you prepare. I'd go it alone, or find another helper.

This is the model for Letter of Intent. You both need to do your own copy of this letter.

As Love Eth says, when you receive your copy of receipt of your I-129F, send a photocopy of it with your letters of intent. Sometimes they do match them up with your initial petition, and otherwise you'll get the RFE (request for evidence). So do two copies each, send one set to the service center and keep one set (just in case they send an RFE). Either way you've lost nothing and may save some time in the process if they do put your first letters with your I-129F. Good luck.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

we didnt submit that when we filed for our I-129F Petition but it still got approved. :)hope for the best but expect the worst. i mailed a letter of intent though to my fiance just in case we got an rfe. maybe u should also do the same.

oh my thanks a lot for all your replies... would it be possible though if i ask my fiance to call back the post mail service he used to forward it to the uscis and ask them if they can hold the form and bring it back to him? oh well this is out of the visa question but just thinking that i could get some answers in regards to this he he but thank you so much big time :)

yes it is necessary.we used rapid visa service on our case.my fiancee sent me a LETTER OF AN INTENT TO MARRY and i signed it then sent it back to him.

hummm those were the days hehehe..im now waiting for our passports..

I am in the same boat. I did not send the intenty to marry form and I just left my fiancee on tuesday 6/28/11. Did I mention I had the forms downloaded on my laptop. AY-YA-YAI! I feel like a dumb fool. I did try to get on VJ while I was there in Haiti but there was no internet access. I am going to mail it to him and have him sign it and mail it back to me to see if they can attach it to my file.

What would I do without VJ and friends...

Sending things to USCIS after you have submitted your petition unsolicited may be an exercise in futility. Even if you were to include a copy of your NOA1, it's still highly unlikely that anything you send after you submit the petition would be matched with your file.

We each submitted those, stating exactly that.. and were RFE'd for it, along with divorce decree not having judges signature (they were initialed)

I agree with the previous poster who said that sending something after you have sent your documents is an exercise in futility.I forgot to inlcude a suppliment to question 18, when we met..... and I sent it with my NOA1 and a letter of instyruction.They just mailed it back to me. So dont bother, just wait till they send you a RFE and then include it.

Does anyone know exactly when this new rule of needing to include the "Letter of Intent" went into effect? I'm wondering if I got mine in before it changed or if I should expect an RFE. I didn't hear anything about it until weeks later. I received my NOA1 on July 8th.

As far as I am aware it isn't a new rule.

It's in the guides, and has been since before I started looking into this last year.
