Timeline

Hello all-

I am about to file the I 130 for my 26 year old brother. He is single for now and lives in Russia. I know that it will take few years for him to get a green card and during the process over the years he might get married. My questions are:

1. Will we be able to change his marital status to married and bring his spouse and possibly kids to US as well?

2. Will his marriage will delay the process due to changes.

3. Would it be better for him to get married first and then to file I 130.

Any relevant information is greatly appreciated,

Timeline:

Married in NY;

I-130 USCIS received: 04/26/2001;

The petitioner/me LPR;

I-130 USCIS approved: 02/18/2005;

LPR became US Citizen on June 14, 2005;

My wife is now in Russia;

I-824 sent: 06/17/2005;

NOA1 receipt notice: 06/22/2005;

Still waitinig;

I-129 sent: 07/25/2005;

NOA1 receipt notice: 07/27/2005;

NOA2 approval notice: 09/02/2005;

NVC sent case# to Moscow on 09/15/2005;

Sent needed documents to my wife 09/19/2005;

Moscow received the NVC package by 09/20/2005;

Moscow to contact my wife ...

It won't make any difference. Married or not, it's the same visa category. You don't petition for his wife or any children they might have. If he gets married then his wife and kids will be eligible to apply for derivative visas. Based on the current visa bulletin you're looking at about 11 years.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
