My employer is filling up the i-129 form for H1-B Visa for me, but he has a problem with the questions regarding Off-Site Assignment. We have established that I will not be working off site and answered NO to the question pertaining tho that in the section Basic Information About the Proposed Employment and Employer.The problem is that further down on pg.19 of H1-B Data Collection Supplement Form, part D Off-Site Assignment of H1-B Beneficiaries there are three more questions about the of site assignment and we are not really sure if we have to answer them at all, and if we do how should we answer them since I will not be working at another location.

Here are the questions which are a bit ambiguous if u ask me:

Part D Off-Site Assignment of H1-B Beneficiaries

a. The beneficiary of this petition will be assigned to work at an off-site location for all or part of the period for which H1-B classification is sought.

b. Placement of the beneficiary off-site during the period of employment will will comply with the statutory and regulatory requirements of the H1-B non immigrant classification.

c. The beneficiary will be paid the higher of the prevailing or actual wage at any and all of the locations.

I know what I would put, but what did the Lawyer say?

Exactly as boiler said.

These question and all the documentation is supposed to be filed by your employer's lawyer not you and him.

If you come to conclusion your employer does not have a lawyer, think twice before accpeting offer from this employer.

I would not....:)
