Well, when my husband came to the interview, the officer told him that he has bad news...

first of all the officer said that the N-400 was send too early... when they spent an hour and a half trying to understand how officers are counting the days they came to the consensus that the n-400 was sent on time. Then officer told my husband that even if the documents were send on time the 90days rule doesn't apply to him... 5 years anniversary of being a green card holder was on 25th of August 2011. We sent n-400 on 27th of July... that means only 30 days earlier... The officer told him that his case was somehow different from others and my husband did not have the right to send it 30 days earlier. He said all people should send their n-400 on the day of their 5 years anniversary...

And the officer was very patient and persistent but also told a lot of unpleasant things... He told my husband that he was over educated and that he was thinking too much... Also he said that this document http://www.uscis.gov/files/article/M-476.pdf is a total bullshit and that no one should take it seriously and everyone should study the law... so... he was a typical bureaucrat.

What was the reason for denial? Maybe you can appeal if it was something small.

11/14/11.....N400 delivered to NE

11/21/11.....Check cashed

11/23/11......NOA recived in the mail(priority date nov 14)(notice date nov 21)..(you will be notified of the date and place of your interview when you have been scheduled by the local USCIS office.you should expect to be notified withing 90 days of this notice)

12/13/11......got text and email about biometric letter being send out

12/17/11.......got biometric letter in the mail(appointment date dec 28th)

12/19/11.....did early walk in FP

12/22/11.......got email and text about being placed in line for interview scheduling

01/30/12.......got email from my IO were i was asked to pick my own interview date and send email back with the date i picked

02/06/12......got INETRVIEW email with appointment letter(have to print that out and bring with me on the interview day)

02/28/12.......INTERVIEW with oath on the same day(as long i pass the test afcorse.)

Document everything along with the date and time and what was said by whom and send everything to your congressman or woman. Write to the USCIS ombudsman. Also, write to the district manager/director at your USCIS local office.

Well, you got to evaluate the options. Did they give you a denial letter? They have to give you a denial letter along with a reason for denial. Once you have that, share with us the reason that they wrote on there. There is a way to appeal that as well. Definitely not a waste of time.

On your entry, you put that your district office is in Connecticut. If you live in CT, then you should contact Sen. Blumenthal. He not only is on the Senate Judiciary Committee, but is also on the Immigration subcommittee of that Committee. He will have at least one immigration specialist on his staff, and USCIS will pay attention to his staff because he is on the subcommittee that is responsible for their oversight. I am very confused about what this officer apparently "said" to your husband? I am no expert but why does the "90 day rule not apply to him"? As far as I knew everyone can file 90 days prior to their 5 0r 3 year anniversary for US citizenship, why would he be different? and I think he is wrong saying that people HAVE to file on their anniversary dates. NO ONE I know on this whole forum has done that? AND also even if the application was sent in too early they should have sent it back and not processed it to tell you he was DENIED!

As I said earlier I am no attorney but I think you have a clear right to appeal, this just doesn't sound fair or right?

Well, when my husband came to the interview, the officer told him that he has bad news...

first of all the officer said that the N-400 was send too early... when they spent an hour and a half trying to understand how officers are counting the days they came to the consensus that the n-400 was sent on time. Then officer told my husband that even if the documents were send on time the 90days rule doesn't apply to him... 5 years anniversary of being a green card holder was on 25th of August 2011. We sent n-400 on 27th of July... that means only 30 days earlier... The officer told him that his case was somehow different from others and my husband did not have the right to send it 30 days earlier. He said all people should send their n-400 on the day of their 5 years anniversary...

And the officer was very patient and persistent but also told a lot of unpleasant things... He told my husband that he was over educated and that he was thinking too much... Also he said that this document http://www.uscis.gov/files/article/M-476.pdf is a total bullshit and that no one should take it seriously and everyone should study the law... so... he was a typical bureaucrat.
