POE and i-94 completed when just passing thru US?

Hello everyone,

My wife recieved her K-3 visa and will be coming here to stay at the end of March. In early march, however, she's travelling with a friend to Mexico. The plane stops off in Miami and then they catch a connecting flight to Mexcio 6 hours later.

Does this short stop in the US constitute the POE so she may need to wait a couple hours since it's her first time in the US? Or since it's just catchiing a connecting flight, then her POE (when she takes her sealed envelope, etc) will be when she comes here in late March?

Also, does she complete the I-94 and then have to give it back to them before leaving Miami for Mexico? I read someplace that they take the I-94 upon leaving the US but I'm not sure. Thanks.

There is no more TWOV (Travel without Visa) Program. Anyone who lands in the US, even though they will be going on to another country will need to clear through CBP Immigration and Customs Controls. When she enters the US, they will activate her K3 visa, so she'll have to bring her sealed envelope and X-ray with her and will need to allow some time for here to go through secondary processing for the K3.

She will have to give up her I-94 when she leaves. Since it is a multiple entry visa, she will be able to come and go as she pleases. Each time she enters the US, she'll have to fill out a new I-94.

Grant,

she will activate her visa when entering the US and going through immigration.

It only took me about 15 minutes longer than usual as I was the only one in the "secondary green folder"-office in Atlanta.

Maybe if she can have about 2 1/2 hour lay-over in Miami that would be enough.

Would she just need the sealed envelope or does she also need to bring the x-ray? They gave us back her x-ray at the Visa interview and I brought it back with me to the US, so I have it and she doesn't. Would she need the x-ray at the POE? Thanks.

I've never heard it asked for before by ancidotes here on VJ and other places, but consular officers have mentioned it in the past...

This is getting more confusing. My attorney felt she should be fully processed in Miami and have her K-3 activated at that time, rather than just going through the transit line. But I Called INS and they thought it would be better if she just goes thru the transit line without fully processeing her K-3 at that point. Then when she comes here for good at the end of March they said she would process her K-3.

I guess mine is an unusual case. It would be easier if my wife didn't have to take this Mexico trip!
