Hi. A friend of mine plans to visit the PI with her son in April 2012. However, she's going to file ROC sometime in Feb.2012. Is it too soon for her to leave before her 10 yr.GC arrives? Whats the normal time frame from ROC filing to GC approval/production? Thanks and I appreciate your info and opinion.

The letter (NOA-2) extends her residency for one year; she can use that to visit.

Typically seems to take six months--the timeframe may conflcit with biometrics timing, but....no other issues I can see.

Where does it say that the (NOA-2) letter extends your Green Card for one year? I believe you because that makes sense, but was wondering if you have seen this in writing somewhere? Does the letter itself say it can be used as an extention? I plan on filing the I-751 in Sept. exactly 90 days prior to my wifes GC expiration. My wife and I want to travel in late Nov. this year and her GC expires in early Dec. I am a little paranoid about the airlines in the Philippines not allowing her to fly on a GC that is expired by a few days even though she will have NOA-2 letter.

Thanks,

Wyatt

Buy, me and my husband are in the same boat as you guys, right down to the months. We will file for ROC in Sept. and plan to visit Sri Lanka in late November, but hope to come back a week before my existing GC expires. But we are kinda worried if that might not be enough time.

It's actually the very first notice you receive after filing. (I think calling it NOA2 is not correct. It's NOA1, or people around here typically call it just NOA.) And it says in the letter that your status is extended for one year.

AOS:

03-20-2009: Married in San Diego (wife: F-1 visa and Chinese citizen, husband: US citizen)

03-29-2009: USCIS received AOS packet

04-03-2009: NOA1 issued

04-23-2009: Biometrics appointment

05-20-2009: EAD received

06-08-2009: Interview, approved

07-06-2009: GC received

ROC:

03-09-2011: I-751 and supporting documentation mailed to CSC via first class mail

03-14-2011: I-751 delivered (5 days to go 55 miles!)

03-16-2011: Check cleared

03-18-2011: NOA received, one year GC extension

04-04-2011: Early biometrics in San Marcos, CA

05-12-2011: Card production ordered! (no email notification, though)

05-17-2011: Approval letter received (approval date 5/12)

Hello! Your friend will most likely NOT going get her 10 YR GC before she leaves for her vacation. Typically the average time fame is 4-6 months but of course each case is different. Some have been approved at the 2 month mark...others at the 8 month mark!! :bonk:

Here's the deal....once she sends off her ROC packet to USCIS, they will send her the NOA approx 1-2 weeks after receiving the packet, to confirm that they actually got it. THEN, she will receive her Biometrics Letter, she should get this within 30 days BUT...if she doesnt, you must wait for the 30 day mark (count 30 days from the "receipt" date on the NOA) before you can call them, and then, IF they are quick with it, she will then receive the Bio Letter within 1 week of calling.

This is what happened with me....there are others who a lot faster, and others still waiting past the 6 week mark for the Bio Letter!! SO...depending on when your friend submits her ROC packet in February and when her 2 YR GC expires....I would definitely advise her to go on Vacation approx 6-7 weeks after submitting her ROC packet, that way she can ensure that she has her NOA (which is the extension letter) and she will know the date of her Biometrics.

The next question is, if she goes on Vacation and her Biometrics date falls on the same time. If she can wait to get her Bio Letter before she leaves on Vacation this would really help, because then she can plan on what do to. She could possibly "walk in" and complete her Bio early if the USCIS allows her in, or she can officially re-schedule the Bio Date till after her vacation, or she can wait to receive the Bio Letter and then book her flights around the date.

IMO....whatever she does, i would strongly recommend getting that NOA letter first - that way she wont have any issues at the airports with regards to her 2 YR GC and the expiration date.

Hope this helps! :star:
