Past K-1 petiion

Hi everyone I actually have 2 questions.

1. I had filed a previous Fiancee petition in 2006. I withdrew the petition becasue the relationship did not work out. I sent in all my information fromt he beginning with this current K1 petition adn also the letter I received saying the previous petition was terminated at my request. Will this cause me a problem? What type of questions will they ask me about this?

2. When I fill out the petition it asks if my fiancee had any childre. He has a daughter but the mother does not want her to come to the US yet as she is only 2 years old. I only listed her to be truthful but do I have to tell them somethign in advance about not petitioning her tight now? They have mentioned her to me when I called NVC but i think it is just becasue she is on the application.

They can ask you about your prior K-1 petition and why you withdrew it but just be truthful and say the relationship was not working. If the CO questions it, he will ask what makes you think this one will work? And just tell the CO how you feel about your fiance.

Regarding the daughter, you have to list her on all the paperwork but when you go to the interview, just tell them the truth, the mom does not want her to immigrate to the US and you should be fine.

As far as the prior petition do be honest and truthful if they ask you a question about it during the interview. If they don't ask, don't bring it up nor volunteer any information!

About the daughter: It is required you list the beneficiary's children in the petition, but listing the children does not mean there is a commitment to bring them over to the US. You can decide whether the beneficiary's children will come to the US, will be "follow to join," or if there are no plans for them to come in the near future. You have choices. Since his daughter is so young, it makes sense for the mother not to want to give up her little girl just yet. Perhaps later, as she enters school.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

You're the petitioner right and you received NOA2 already correct? Then your previous petition does not matter anymore cause only USCIS was concerned with that. They always say they will inform the beneficiary of any of your previous filings to warn her so that she knows what she's getting into.

Or are you saying that you filed for this same person before? In that case the beneficiary may be asked to explain why it didn't work out previously.

What does NOA stand for ?

Notice Of Action, thats that I-797 form that USCIS sends you, usually just two unless maybe you get an RFE.

NOA1 - 12/21/15

NOA2 - 04/18/16

NVC Receive - 04/29/16

NVC Welcome - 05/13/16

DS-261 - 05/14/16

AOS, IV PAID - 05/27/16

DS260 done - 06/10/16

Case Transferred to US Embassy in Riga Latvia at the end of October.

These are jst in the initial petition stage yes? (the forms my fiancee filed)

Or are there more with the K1 forms i file too?

Yes they are the forms that the US citizen fiance filled with USCIS.

The second stage is filing forms for the embassy. The forms you, the beneficary, will fill for the embassy are the department of state forms, once your fiance gets the approval for your petition from USCIS.
