Funny that you asked about DL in PA. I just renewed mine and according to penndot's website, as adjustment of status applicant you need:

- Social Security Card,

- 2 proofs of residency,

- immigration documentation indicating status such as I-797 Receipt Notice, Biometrics Notice, Interview Notice, Court Order of Immigration Court hearing,

- one of the following: EAD, passport, copies of documents certified by the Applicant's attorney or by an accredited Board of Immigration Appeals (BIA) representative may be permitted if person's passport is held by immigration agencies in court procedure

That is the same here in Denver. I went to the DMV and was given a piece of paper with the requirements on it. But it never said proof of notice for A.O.S on it. I needed proof of address, I-94 (unexpired) SSN, and proof of person (passport/uk driving license). I stood in line for 40 minutes and was told I could not apply until I had the NOA for my A.O.S.

I can drive my wife's car (I am on her insurance) until I apply for my test when I get the N.O.A. or until my I-94 expires in about 20 days.

Hi fellow VJ,

I'm now here in Alabama. we talked to one person that she showed only her EAD and she was able to have a written exam,but that was before. i just don't know now if they have change. any insight? thanks

I live in Alabama also and my wife (who entered on a K-1) had to wait until she received her green card approval notice before she was eligible for her driver's license. Alabama is very picky - they will accept an EAD but only if combined with a SS card and a visa authorizing a presence in the U.S. of over 160 days. So a K-1 visa does not qualify as it only authorizes a presence of 90 days. Basically they want proof that you are allowed to stay in the U.S. for at least 160 days which an EAD alone does not prove (at least according to their regulations).

From what I've seen, in many states the guidelines are unclear and not all workers at the DMV understand them and/or enforce them the same.

(She's been studying for the last two weeks. good.gif) After reading these posts, I decided to double check the requirements and almost thought we wouldn't be able to get it with just the EAD but then I saw the magic word "or", as in EAD or unexpired I-94... Whew!

I think I'll print out that page to take with us tomorrow in case we run into a clerk with little K-1 experience.

They will give the license or state ID in FL with just the EAD. My husband got a state ID with his EAD. However, they require sending it to Tallahassee and waiting the extra processing time, then you receive it in the mail within 30 days. His did not take the 30 days, just shy of 2 weeks. It is marked Temporary, and expires when the EAD does. When you get the green card, you can go back in and get one for the normal amount of years they are issued for. You have to then pay for it again, of course. Good luck to your wife passing the test!

which part in Alabama are you in? does she has already her greencard? we will try tomorrow coffee county also to apply for my written exam. the only reason why were such in a bit hurry because our interview date will be on July 27. My husband will be gone for his annual training for 2 weeks on July 9 and by the time he will be back, 2 days left before our interview. he wanted me to add to his car insurance as one of our evidence for our upcoming interview which he can't since i dont have a drivers license.. any suggestion? thank you

we went to the state trooper yesterday and i showed that i have a EAD and also my passport,original form NOA 797 issued by the DHS showing approval of change of status( thats what in the Drivers manual) but they refused to let me have my written exam.i wonder why?they are still asking for a document that I have been already approved. I can't be approved yet since our interview would be next month. my husband wanted me to include in his car insurance but then,how can he include me if i don't have a drivers license.they were also asking for SSN and we just applied for SSN and i dont have yet the card itself.we went to the SSN office yesterday and they gave me the number but not yet the card.they were also looking for my I94 and we said, my I94 has been expired since i came here as a tourist visa.also the biometrics letter.and we said,we've been through with that and my fingerprint is on the EAD card.i guess,what they were really looking a document that i have been approved already. any insight?pls help.. thanks

First things first, please add your timeline to your "about me" section or signature area so that you don't keep posting it in your posts.

Second, you did NOT give them what they're asking for. You stated that you showed the "NOA797" and that it's your "approval of change of status" but it's not. It's a RECEIPT it's not the approval. You stated you haven't even had the interview yet and that it's next month so your your status isn't yet approved so you can't have a letter stating "approval of change of status".

They will permit a licence normally once she has her EAD, so it's odd that when you showed them that they wouldn't approve it... Wait until you get the SSN card in the mail AND the EAD and you should be fine.

I think it differs from state to state, when I went to apply (In Denver), I was told I need proof of address, my U.K license, S.S.N if possible and NOA1 as proof that I have filed for A.O.S. and marriage license. I did not need E.A.D. or have to have had an interview.

Regarding the car insurance, I was added to my wife's insurance (Geico) but I had to be added as a "International driver" in the section where it asks what state license I had. It was no extra cost either. Maybe you could phone them to assist.
